JASPER COUNTY GA Richard Mitchell - will -1818 File contributed for use in USGenWeb Archives by meredithclapper@earthlink.net (Meredith Clapper) gerelyn222@aol.com Ordinary Office, Jasper County, GA p 353-4 To all who these presence may come knowing that I Richard Mitchell of the county of Jasper and state of Georgia do hereby viewing the certainty of death and being in much bodily affliction tho in sound (mind) & memory make this my last will and testament viz 1stly I resign my body to its mother dust and implore divine mercy for the happy reception of my soul. 2ndly I desire that all my just debts should be paid. 3rdly I give and bequeath unto my dear and beloved wife Elizabeth Mitchell all my estate during her natural lifetime or widowhood and no longer with the following exceptions i. e. at any time when any or all of my three daughters (viz) Polly Finch Mitchell, Elizabeth Mitchell, and Sarah Mitchell should marry then and at that time they or either of them is each of them to have a negro girl from the estate or proceeds thereof of the age of twelve or fourteen years, one good horse saddle, one good bed and furniture, but previous to which if either of them should die then and in that case their portion is to (be) equally divided between my surviving daughters. 4thly At the death of my wife or at her intermarriage with another then the ballance of my estate with all its future proceeds is to be equally divided between my sons (viz) William Mitchell, Walter Mitchell, Robert Mitchell, Richard Mitchell, Joshua Mitchell & Joel Mitchell deducting from Walter Mitchell one hundred dollars, from Robert Mitchell one hundred dollars & from Richard Mitchell two hundred dollars that they have already received in land. 5thly I do hereby constitute and appoint my sons Walter Mitchell & Robert Mitchell my true and lawfull executors to carry this my will fully into effect in testimony whereof I have here unto set my name and seal this 18th of February 1818. Whatley James Beeland Jesse Holloway Monday September the 7th 1818 The honorable the court of ordinary met pursuant to adjoinment present their honors John Rivers} John Moore} Barrett Crawford} Judges & Hiram Glazier} Robert Mitchell having been appointed Executor of the last will and testament of Richard Mitchell deceased and after qualifcation as such having declined to perform the duties incumbent upon him as such, It is therefore ordered that the _____ ____ ____ granted to the said Robert Mitchell be and the same is hereby repealed. Whereas Richard Mitchell deceased did by his last will and testament of appoint Walter Mitchell and Robert Mitchell executors of his last will and testament, the first of whom having declined qualifying and the latter after qualification declining to serve and perform the duties of Executors It is thereupon ordered that Elizabeth Mitchell widow of the said Richard Mitchell be and she is hereby appointed administratrix on the Estate of the said Richard Mitchell deceased with the will annexed. and legatees report the widow's dower to be laid of in the following manner to begin at a stake on the midle of the lot of land of which the said Richard Mitchell died ___ed and possessed of and on the line adjoining James Brown's land and running a direct line through the middle of said land untill a stake on the line of said lott adjoining Reubin Edwards devideing, said lands in two equal parts the lower or south esterly part including the mansion house and other building and in which part we have included the distributive shares of Joshua Mitchell, Elizabeth Mitchell and Sarah Mitchell and the other half of the said lands to be laid of in size equal shares both as the quantity and quality which shares shall be considered the property of Will Mitchell Walter Mitchell Robert Mitchell Richard Mitchell Jore [Joel] sic Mitchell and Aristarety Newton in wright of his wife-and it is hereby agreed by the commissioners aforesaid that the one third part of the the said tract of land of which the said Richard Mitchell died seized (?) and possessed of which we have laid of to the widow Elizabeth Mitchell shall be and remain her proper right and property for and during her natural life time and at her death to be equally divided amongst all the children or their legal representatives of the said Richard Mitchell decd. and Elizabeth Mitchell his wife shair and shair a like. carried to book F, folio 219 (or 217) ======================== USGENWEB NOTICE: In keeping with our policy of providing free information on the Internet, data may be freely used by non-commercial entities, as long as this message remains on all copied material.
