When the purchase money was to be paid, a copy of which bond is hereunto annexed and the said George having died without executing titles or making provision therefor by will---it is therefore ordered that the administrator on the estate of said George be and appear at the next term of this court after the experation of three months and show cause if any, why he shall not execute titles to said land according to the tenor and effect of said bond, and that a copy of this rule be published once a month for three months. For that wheras the said Samuel HARREL administrator as aforsaid, and shilst the said Mahaley was joined and intermarried to wit on the first day of January in the year eighteen hundred and twenty nine was indebted as administrators aforsaid to the same Mahley inthe sum of two hundred dollars for the work and labour of the said Mahaley by her before that time done and performed for the said Yancey THORNTON whilst he was administrator and at this specialy instance and request bestowed in bourding clothing and washing for William RICHARDSON Mahaley RICHARDSON and Allen RICHARDSON infant heirs of George RICHARDSON deceased for and during the years eighteen hundred and twenty seven and twenty eight and being so indebted to the said Samuel HARREL aministrator as aforsaid in consideration ---? afterwards and shilst the said Mahaley was joined and intermarried to wit on the first day of January in the year eighteen hundred and twenty nine in the County aforsaid undertook and faithfully promised the said Mahaley to pay her the said sum of money when thereto afterwards requested. And whereas also afterwards and whilst the said Mahaley was joined intermarried to wit on the first day of January in the year eighteen hundred and twenty nine aforsaid in the county aforsaid in consideration that the said Mahaley at the Her? like official instance and request of the said Yancy and Samuel had before that time boarded clothes and washing for William Mahaley and Allen RICHARDSON infant heirs of George RICHARDSON decd. during the years eighteen hundred and twenty seven and twenty eight promised the said Mahaley to pay her so much money therefor as she reasonably deserved and the said Thomas J. MC GHEE and Mahaley his wife aver that the said Mahaley whilst she was joined and intermarried therefore reasonably deserved to have the aforsaid sum of two hundred dollars Yet the said Yancy THORNTON whilst he was administrator and the said Samuel HARREL administrator as aforsaid not regarding their said pious ? and understanding but contriving craftily and subtly to deceive and defraud the said Mahaley whilst she was joined and intermarried and the said Thomas J. MC GHEE and Mahaley his wife since their intermarriage in this behalf hath not as yet paid them said sum of money or any part therof to the said Mahaley whilst she was joined and intermarried to the said Thomas J. and Mahaley his wife given their intermarriage or either of them. YOUNGER HILL and defends the wrong and injury when Ill. & for answer saith that he did not undertake re his mauseur ? (manner?) & loan? as plaintiff hathe declared against him of which he puts himself upon the county & G. Herefor further plea this defendant saith that the plaintiff ought not to have & maintain his said action against him in this behalf for this, that this defendant advertised in publications of the law for all ----to present their claims against the estate of George RICHARDSON decd. within the time published by law, but said claim was not presented to this defendant as administrator de bois now of said estate & that the assets of said estate liable to this fund are exhausted of which he prays judgement of the court & puts himself upon the Mercy. And for furthur plea this defendant saith that the accrual in cause of said estate was insufficient to pay the amount charged for the support of the ---? thereof & the Court of ---? BEASLEY of the county aforsaid owe and detain from your petitioner the sum of two hundred and eighteen dollars besides interest--for that whereas the said William G.W. & William P. on the sixteenth day of January in the year of our Lord eighteen hundred and thirty four made their certain instrument in writing, commonly called a promissory note the date whereof is the day and year aforesaid, their own propr hand being thereto subscribed and then and there delivered the said note to your Petitioner which is now here shewn to the Court, Whereby by the 25th of December next (thereafter) they or either of them promised to pay your petitioner or recover two thousand and sixteen dollars for ---- received. yet the said William G.W. & William P. although so indebted to pay the said sum of money often thereto afterwards requested have not paid the same but the same to pay have refused and still do refuse to the damage of your petitioner three hundred dollars.
