If you have corrections, please email me at p2willia@oakland.edu or find my files on ancestry.com. < . > James C Robinson John L Robinson Executors of Wm C Robinson dec Application to prove will of Vs William C Robinson Sarah F Robinson Application having been made by the above named executors to prove the will of the said Wm C Robinson dec in this court, and the parties having been duly notified that the same would be proven in solemn form at the February term 1858 – and the said Sarah F Robinson having appeared at the said term, by her counsel and interest her Caveat - and the same having been heard - an agreement was made by the parties that the said course should be carried to the appeal by consent, and that the cost in the same should abide the final trial – And upon the said appeal being called up on the September term of the Superior Court, last the said Caveator having withdrawn her caveat of the appeal being dismissed & the papers ordered to be returned to the court for the probate of the said will – And the said executors James C Robinson and John L Robinson having on the 9th of October at an adjourned term of the court again appeared and provided an (instrument?) purporting to be the last will and testament of the said Wm C Robinson dced, the same being the will afore said and the said providers being the (_ _ _ _ ? nominated?) executors of the same – and the same being proven in open court by the affidavit of Joseph H Martin one of the subscribing witnesses in common form. It is therefore ordered that said instrument in writing be admitted to record as the last will and testament of William C Robinson dec and the said executors have leave to qualify and upon so doing that letters testamentary issue to them. James C Robinson & John L Robinson nominated executors to the last will & testament of William C Robinson then took the oath prescribed by law – letters testamentary was then issued to them as excts of said will & testament of said decd. Georgia Newton County In the name of God, Amen I, William C Robinson, being of sound disposing mind and memory and considering the uncertainty of this mortal life do make and declare this my last will and testament in the following manner. Item first, I wish my body to be buried decently adjoining my fathers grave, I also wish a monument erected over my grave, the cost of which I leave to the discretion of my executors Item second. I wish all of my legal debts paid “ third I give and bequeath to my wife Sarah F Robinson one bed and bedstead, one bureau and one table and a half a dozen chairs, I also give or bequeath to her five dollars to be paid to her by my executors, which is all of my personal or real estate that I intend her ever to receive, knowing that she has not abided the part of a wife to me. Item fourth I wish my property to be sold and equally divided among my children Item fifth I wish the property of my daughter Mary F Robinson and Emma Robinson to be kept for their sole and separate use for and as long as their natural life, free and exempt from the debts of their husbands. Item sixth. I give and bequeath unto my son John Walter Robinson my library composed of medicine, literary, and miscellaneous books and catalogs of which I wish kept so that the books may not get lost or impaired (impuned?) Item seventh I wish my son John Walter Robinson to be educated for a physician Item eighth I give and bequeath unto my daughter Mary F Robinson the piano forte now in the parlor of my house, for her own use to be free and exempt from the liabilities of her husband provided she should marry. Item ninth I hereby constitute and appoint my beloved brother John L Robinson guardian of the person and property of my son John Walter Robinson during his minority Item tenth I hereby constitute and appoint my brother James C Robinson guardian of the person and property of my daughters Mary F Robinson and Emma Robinson during their minority or until either of them should marry Item eleventh I hereby constitute and appoint my brothers James C and John L Robinson executors of this my last will and testament hereby revoking all others heretofore made by me. Witness my hand and seal this the twenty fourth day of November in the year of our Lord one thousand eight hundred and fifty seven. C. Robinson the testator sign the same and publish the same as his last will and testament – that at the time of said signing and publishment the same W.C. Robinson in the opinion of (reponent?) was of sound and disposing mind and memory & that he executed the same freely and without compulsion so far as he knows and believes and that he saw James M Williams and Jno R Godkin sign the same as witnesses and that they all signed the same in the presence of the testator & of each other Sworn to & subscribed in open Court October 9th 1858 (signed:) Joseph H Martin (signed:) Wm D Luckie Ordinary *GLOSSARY: CAVEAT That he beware.
