Item 1st It is my will that all my just debts be paid.' Item 2nd I give and bequeath unto my wife Margarett Williams during life and in the event of her having a child, the property given to be at her disposal, the following property to wit, one half of the tract of land on which I now live including the house the line to run northwest and southeast, commencing at the creek and running to the road, one negro man named Martin, one negro girl named Martha, one gray mare, and black colt, two cows and calves and a sufficiency of hogs, sheep, plantation tools and cooking utensils for the use of her family, one years provisions of meat, wheat, corn and fodder, one yoke of oxen and cart and bed, bed stead & furniture, one walnut table, one pine table, one side board, four sitting chairs, the crookery knives and forks five dogs & smoothing trous on hand, together with all the articles of household furniture she had at the time of our marriage; and at the death of my wife in the event of her having no child. the negro & land portion of the estate with all the increase to be considered a portion of my estate and to be equally divided among the legatees of the same as herinafter stated, the remainder of her estate to be at her own disposal. item 3rd I give and bequeath unto my son in law John S. Irby the proceeds of my tract of land in Butts County, now in his possession at Seven hundred and fifty dollars, one note of hand on said Irby for Seventy Seven Dollars dated ninth February 1844 one feather bed heretofore given at Fifteen dollars and when my other children to wit John Williams and Nancy Williams and the child or children of my daughter Elizabeth H. Hartsfield, shall have had the same amount the accounting for what they have had. The remainder of my estate (not disposed of) to be equally divided amongst my children to wit Martha R. Irby, John Williams & Nancy Williams and the child or children of my daughter Elizabeth H. Hartsfield. Item 4th I give unto John Williams Two negros Alsie (sp) and Amos already in his possession at five hundred dollars. Item 5th I give unto my son in law James M. Williams one excution on John C. Gibson, already in his possession at five hundred dollars. Item 6th I give and bequeath unto my granddaughter Sarah A. Hartsfield, daughter of Meadleton & Elizabeth Hartsfield and to such other children of my daughter as may hereafter be born. My tract of land lying near Concord M__ting House containing one hundred & twenty five acres at five hundred dollars and four hundred dollars in cash to bear interest from 1st day of January 1846, one curtain bedstead bed & furniture to be taken as an offset against what I have given John Williams & Nancy Williams and a sufficiency of my estate to making her equal in a final division with my three children. & it is further my will and desire that the above legacy in land and other property to be selected by my excutor with the advise of friends be kept together for the sole and separate use support and maintainance of my daughter Elizabeth during life and her child or children, but in no way whatever to be considered the property of Meadleton Hartsfield or in any manner whatever subject to his control or liable for his contracts & it is further my wish and desire that James M. Williams act as trustee in carrying out my intention for the sole and separate use support and maintainance of my daughter and the benefit of her child or children. Item 7th It is my will that in the event of the death of my daughter Elizabeth H. Hartsfield leaving no child, that her child portion of my estate be divided equally amongst the children of my son John Williams. Item 8th It is my will that that portion of my tract of land, not disposed of on which I now live be taken by James M. Williams at valueation Item 9th It is my wish and desire that my negro property not disposed of be sold to the highest of my children and that David and Hannah be sold together. the remainder of my estate not disposed to be sold on a credit of twelve months. Item 10th I do hereby appoint and ordain James M. Williams executor to this my last will and testament. In testamony where of I have hereunto set my hand and sea.
