  Will of DANIEL FREEMAN


I Daniel Freeman of the State and County aforesaid, knowing that all men
have to die, do ordain this to be my last will and testament.
 
Item 1st., I will that all my debts be paid out of cash on hand if any, and if 
not
out of any personal estate by my said executor hereafter to be named.

Item 2nd, I will after my decease that any said executor advertise any land
and personal property and perishable property in the town of Monticello, and
any other place in Jasper County- thirty days, and sell the same at public
auction, and divide the proceeds amoung my children, equally to wit: James
Freeman, John Freeman, Theophilus Freeman, William Freeman,Bosdel Potter,
Jonathan Bonner, Jessee Pye, and the heirs of the body of my daughter
Clary Hopper, and the heirs of the body of my daughter Sarah Lacy.

Item 3rd, I will after my decease that my said executor notify all the above 
named legatees by letter, thirty days, to come together and if a majority

think it best to divide negros then that my executor notify five fit and proper 
persons to divide them by lot and if a majority of them think it best to sell 
them

then my said executor to set that up and sell them for divisees and each 
legatee above named to have an equal part of the proceeds.


Item 4th, If there should be any money amounted on hand at my death, after 
my debts are paid , the balance to be equally divided between the above
 named legatees by my said executor.


Item 5th, I do appoint James Freeman to be my executor to this my last will
and testament. In witness whereof I have set my hand. January 20th 1840.
