I, PENNY HUDSON, of said state and county, being of advanced age and feeble health and knowing I must shortly depart from this world, deem it right and proper both as respects myself and my children that I should make a disposition of the property with which a kind Providence has blessed me with. I therefore make this my Last Will and Testament, hereby revoking and annulling all others heretofore made by me. Item First: I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition, my soul I trust shall return to rest with God who gave it as I hope for eternal salvation through the blessed Lord and Saviour Jesus Christ, whose religion I have professed, and as I humbly trust enjoyed for about thirty years. Item Second: I desire and direct that all my just debts be paid without delay by my Executors hereinafter t obe named, as I am unwilling my creditors shall be delayed of their rights especially as there is no necessity for delay. Item Third: I give and devise to my beloved friend MOSES BRINSON, in trust for my son JAMES C. HUDSON, all my land on which I now live containing Nine Hundred and Ninety-Five acres be the same more or less; and if my sn JAMES C. HUDSON should die without a child or children, I wish his trustee MOSES BRINSON to sell the same and make an equal distribution of the proceeds of the sale to be placed in the hands of the trustee of my other children to be managed as herein after directed. I also give and bequeath to my son JAMES C. HUDSON the two following negro men namely, Thomas (a negro man) about twenty or twenty-one years of age, and Ellis (a negro man) about twenty years of age. I also give and bequeath to my son JAMES C. HUDSON all my stock of cattle, mules, hogs, sheep, plantation tools, carts and wagon, buggy, household and kitchen furniture, crops and in short, all that is on the place, with the exception of two feather beds, one of which I give to JANE FARMER and the other to CAROLINE CLARK, wives of ENOCH FARMER and PHILIP CLARK. Item Fourth: I give and bequeath to my daughter, Mrs. ELIZABETH MATTHEWS, one negro slave girl by the name of Caroline aged about eleven or twelve years to belong to her and her children. JAMES C. HUDSON, my son, to be trustee. Item Fifth: My negroes, the balance of them left after the above benefits, are to be equally divided according to value, between my daughters now living and the children of my deceased daughter, SARAH WHIGHAM, these children collectively to have one share the above named balance of negroes given to be divided between my daughters, to be placed in the hands of my son JAMES C. HUDSON in trust for them and their children, and the children of my said daughter, deceased. The title to remain in the trustee for my said daughter and daughters children and should my son die as before statedd without child or children the proceeds of said sale of land after being placed in the hands of a trustee in like manner with the sale of the negroes to be a portion of the same. Item Sixth: I constitute and appoint my friend MOSES BRINSON and my son JAMES C. HUDSON Executors of this my Last Will and Testament, this April the twenty-sixth Eighteen hundred and fifty-four.
