I, JOHN McMAHAN, planter, of the State of Georgia, Jefferson County, January 9th in the year of our Lord one thousand eight hundred and three and in the twenty seventh year of the independence of the United States of America, being in perfect health, mind, and memory. Thanks be given unto God calling unto mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this my Last Will and Testament. That is to say principally and first of all I give and bequeath my soul into the hands of Almighty God that gave it and my body I recommend to the earth to be buried in a decent Christian burial at the discreation of Executors nothing doubting but at the Great Day of Resurrection I shall receive the same again by the might power of God and as touching such worldly estate wherewith it hath pleased God to belss me in this life, I give, dispose of the same in the following manner and form. First -- I give and bequeath unto JAMES TRIMBLE and to each of his children, five shilling at my decease. Also I give and bequeath to MARY McGOWEN my niece one horse to the value of one hundred dollars and one new saddle. Also, I give and bequeath to my beloved wife FANNY the remaining part of my estate during her widowhood and if she should marry again, it is my will and desire that MARY McGOWEN and JAMES TRIMBLE and daughter MARGARET should have the third part of all my estate, land excepted. I likewise constitute make and ordain JOHN BIGHAM, ROBERT FOYLE, ALEXANDER GORDON to be my whole and sole Executors of this my Last Will and Testament and I do hereby utterly disallow, revoke, and disnull all and every other former testament Will bequests and Executors by me in any wise before named I willed and bequeath ratifying have hereunto set my hand and seal the day and year above written. Signed, sealed, published, pronounced and delivered by the said JOHN McMAHAN as his Last Will and Testament in the presence of us, who in the presence of each have hereunto set and subscribed our names. Witnesses JOHN BIGHAM /s/ JOHN McMAHAN ALEXANDER GORDON ROBERT FOYLE Georgia ) Jefferson County ) At a Court of Ordinary held in and for the County aforesaid on the 1st of May 1809 Personally appeared ROBERT FOYLE one of the subscribed witnesses to the annexed Last Will and Testament of JOHN McMAHAN, deceased, and being duly sworn deposeth and saith that he was present and did see the Testator sign and acknowledge the same to be and contain his Last Will and Testament and that he was of sound and disposing mind and memory to the best of his knowledge and belief, and that JOHN BIGHAM and ALEXANDER GORDON together with this deponant did subscribe their names as witnesses thereto in the presence of the Testator and in each others presence. She married JESSE HERRIN on 19 April 1810 in Jefferson County, Georgia. I have found no other McMahan / McMahon marriages during this time frame yet.
