I Silus Powell of said State and County being of advanced age, being of sound and disposing mind and memory, knowing I must shortly depart this life deem it right and and proper both as respects my family and myself That I should make disposition of The property with which a kind Providence has blessed me. I do Therefore make This my last Will and Testament hearby revoking and annulling all others by me heartofore made. First__I desire and direct That my body be buried in a decent and Christian like manner suitable to my circumstances and condition in life. My Soul I Trust shall return to rest with God who gave it as I hope for salvation Through The merits and atonmements of The blessed Lord and Savior Jesus Christ. Secondly__I desire and direct that all my just debts be paid without delay by my Executor hearin after named and appointed. Thirdly__I give bequeath and devise to my beloved Wife Letha Powell my Lot of land in The fifty_fifth and Twelve hundred and Third District of Johnson County containing Three hundred acres more or less with all The rights members and appertenances To Said Lot of land in any wise belonging my (sic) free rom all charge and limitation whatever This is during her natural life only. I also give and bequeath to my beloved wife in the same unreserved manner The farming utensils used and belonging to The farm on the said (place) lot of Land and The stock of all kind and all The house hold and kitchen furniture during her natural life only. Forthly__ I give and bequeath to my beloved Wife Letha for and during her natural life only my negroe woman Harriet about Twenty years of age. Winny about Thirty years of age and at her death The property both real and personal sold and equally divided among my children. Fifthly__ I desire and direct that Three hundred Dollars be paid to Lewis Davis as son of my daughter Nancy Davis. The property devised and bequeathed in the above article to my grandson Lewis Davis is in full ____ of his whole right in my estate. I hearby appoint my Trustworthy fried James A. Davis guardian of the person and property of my said minor grandson. Sixthly__ I desire and direct The ___ of my negroes be sold and The proceeds to be equally divided among The children namely. Saffa Fortner, Polly Fortner, Milla Meadows, Malinda Williams, John W. Powell, Tempy Powell, Laney Powell, Martha Powell, Bleson Powell, Leston Powell. I give and bequeath to my daughters namely Saffa Fortner, Polly Fortner, Milla Meadows, Malinda Williams, Tempy Powell, Laney, Martha, Bleson Powell, for their sole and seperate use for and during Their natural life free x exempt from the debts & liability of their present or a future Husband. Price Estate of Silus Powell State of Georgia Johnson County By virtue of an order from the Honorable Court of Ordinary of said county to us directing authorizing & requiring us to make distribution of the estate of Silus Powell deceased late of said county among the distributees entitled to said Estate we proceed this day to the performance of that duty. there were twelve distributees to wit (sic) S.M. Fortner, J.T. Fortner, John W. Powell, _____ Powell, Melinda Williams, Martha Powell, Dilano Powell, J.W. Meadows, J.W. Meadows Guardian for L.S. Powell, Litha Powell, J.A.Davis Guardian for Lewis Davis, William B. Price all legal heirs of said deceased. The money brough by sale of all the negroes and other property was divided into twelve equal shares which was paid over to the distributees the amount being two thousand five hundred and ninety two 73/100 dollars which was paid over and ____ for it being the amount produced by the Administrator for distribution which is respectuflly submitted this February 13, 1865.
