Nancy Jane Newby, born June 04, 1851 in GA; died January 28, 1897 in Attala Co, MS. She was the daughter of 2. Daniel Jefferson (Jeff) Newby and 3. Sarah Elizabeth (Betsy) Cleland. She married James Madison Simmons February 14, 1878 in Jones, GA. He was born May 03, 1843 in Monroe Co, GA, and died December 14, 1922 in Attala Co, MS. He was the son of John William Simmons and Bethiah Middlebrooks. Nancy Jane Newby died 3 months after her last child was born on Jan 28, 189717 and the family buried her at Center Point Cemetery in Attala Co, MS. Generation No. 2 2. Daniel Jefferson (Jeff) Newby, born February 22, 1826 in GA; died February 15, 1882 in Jones Co, GA. He was the son of 4. John Nelson Newby and 5. Jane. He married 3. Sarah Elizabeth (Betsy) Cleland November 22, 1849 in Jones Co, GA. 3. Sarah Elizabeth (Betsy) Cleland, born October 18, 1832 in GA; died March 30, 1914 in Jones Co, GA. She was the daughter of 6. William Robert Cleland and 7. Nancy Glass. Before Daniel Newby married Elizabeth Cleland he signed an agreement that he would not have any claim to his wife estate if she died before him and that her estate would go to their children (Return Books p 377, Jones Co, GA courthouse). Jeff must have really loved Betsy to sign this agreement during the 1840's. The Jones Co, GA 1850, 1860 and 1870 censuses listed him with his wife and many daughters. Occupation listed as a farmer. The value of his real estate and personal estate for each census was $500/?, $4000/7000 and $5000/?. He purchased over 2000 acres of land in Jones County (Jones Co, GA Deed Books) between 1852 and 1878. He recorded his will in the Jones Co, GA Will Records Book E [1865 - 1914] on pages 185 - 8 and in Record Book BB starting on page 572 and continuing off and on to page 780. He left his property to his wife and set-up conditions for his children (son-in-laws) to pay his estate for their share of his farmland. The family buried Jeff Newby and his wife in the Cleland/Newby Cemetery off of Round Oak Juliette Road in Jones County near East Juliette. Inscription on their head stone reads "Dear parents that we love you much We know you rest with Lord"9,12. Russell family and the Jones County newspaper (see a memorial to her below) records indicate Betsy Newby was the mother of eleven girls and one boy.15 She was listed in the 1910 Jones Co, GA census living with her retarded daughter Fannie and her grandson Jeff Hardin age 19. She could not read. Her will was recorded in the Jones Co, GA Will Record Book E pages 454 - 5. On the next page are pictures of the sisters Nancy Jane Cleland Mitchell and Elizabeth (Betsy) Cleland Newby on the right most likely taken around 1900 and article from the Jones County Newspaper from April 9, 1914 Children of Daniel Newby and Sarah Cleland are: i. Sarah Elizabeth (Lizzie) Newby, born January 18, 1855; died January 08, 1911 in Jones Co, GA; married William B. Russell February 01, 1877 in Jones Co, GA; born May 03, 1854; died July 18, 1931. Lizzie's mother gave her 200 acres of land on which was built a white home still occupied today by Bobby Russell on Round Oak Juliette Road in Jones County. The home named Miss Jeffie Farm after Miss Jeffie Russell a long time resident of the house.49 Lizzie died from pneumonia51 and she and her husband were buried in the Cleland/Newby Cemetery. William B. Russell owned a large farm, a sawmill and served as a County Commissioner and tax collector in Jones County.52 vi. Martha Levin Newby, born July 11, 1857; died December 30, 1939 in Jones Co, GA; married John Silas Hardin February 27, 1884 in Jones Co, GA; born May 24, 1853; died March 24, 1897. vii. Emma Newby, born April 08, 1859; died November 02, 1921; married (1) Burrell H. Mobley October 01, 1878; married (2) William S. Tyner Abt. 1890. viii. Amelia A. Newby, born July 15, 1861 in Jones Co, GA; died July 25, 1862 in Jones Co, GA. ix. Georgia Bethenia Newby, born January 03, 1863; died February 01, 1891; married G. L. Hardin, Jr. April 10, 1890 in Jones Co, GA. x. Ava Jeffie Newby, born July 01, 1865; died October 02, 1889; married George Lamar (Dock) Hardin January 11, 1888; born March 10, 1862; died July 25, 1951. xi. Josephine (Jo) Newby, born January 11, 1867 in Jones Co, GA; died January 21, 1956 in GA; married George Lamar (Dock) Hardin December 07, 1890 in Jones Co, GA; born March 10, 1862; died July 25, 1951. Aunt Jo married Dock Hardin a year after his first wife and her sister Jeffie died. My grandmother Bessie Simmons and her sister Eula came to live with the Dock and Jo Hardin in 1901 after Nancy Newby died.35 Nancy was Bessie's mother and Jo's sister. Eula Simmons was still living with them in 1910 according to the Jones Co, GA census. Aunt Jo and Uncle never had any children of their own. Uncle Dock and Aunt Jo lived in a house on Barron Russell Road near East Juliette in Jones County where they farmed and raised dairy cattle. She and her husband still lived in their farm home, which they owned in 1930 per the census. For a picture of the house see Chapter One. According to family members Uncle Dock and Aunt Jo were always looking for a handout or two and seemed to show up at a relative's home unannounced around mealtime.49 The family buried them in the Cleland/Newby Cemetery near their home. Dock lies between his two wives. William B. Russell and wife Sarah Elizabeth (Lizzie) Newby Russell and George Lamar (Dock) Hardin and wife Josephine (Jo) Newby Hardin Bessie Simmons Roberts on porch, Dock and Jo Hardin and Oscar Paul Simmons at the Hardin's home in Jones County Georgia around 1950 xii. Leila F. Newby, born April 25, 1868 in Jones Co, GA; died May 01, 1890 in Jones Co, GA. xiii. William Jefferson Newby, born June 1873 in GA; died 1950; married Fannie S. Jackson abt. 1894; born April 1875 in GA. In 1900 William Jefferson Newby lived with his wife and three children on a farm in a house they owned with no mortgage per the Jasper Co, GA census. On December 15, 1912 the police arrested W. J. Newby for shooting Alonza Tribble in western Jones Co, GA. They were arguing over hiring a black man and Newby shot Tribble with a pistol. The bullet lodged near Tribble's spinal cord. An operation removed the bullet, but Tribble died several days later from meningitis. On May 1, 1913 Newby was found guilty of assault with intent to murder with a recommendation that he be punished for a misdemeanor. The judge ordered Newby to be sentenced to the chain gang for twelve months. The judge also ordered that the defendant may be discharged at any time by the payment of $750. He paid the fine43 [Jones County Minutes Book 1910, Jones County Superior Court]. Sometimes after 1913 he and his family moved from Jasper County to a farm in Grady County located in southwest Georgia on the Florida border according to the 1920 and 1930 census. His family returned to either Jasper or Jones Counties after 1930.49 Generation No. 3 4. John Nelson Newby, born Abt. 1778 in NC; died July 27, 1836 in Jasper Co, GA. He was the son of 8. Jesse Newby and 9. Keziah Tatom. He married 5. Jane. 5. Jane, born Bet. 1790 - 1800. I have only indirect proof that John Newby was Daniel's father. This includes the following: {1} Larkin Newby, John's son and Daniel's brother, was buried in Cleland/Newby Cemetery only about twenty feet from Daniel's grave, {2} Jane Newby, John's widow, purchased oats from the estate of William Cleland, Daniel's future wife's late father [see write up on William Cleland on the next page], {3} Jane Newby's 1840 Jasper Co, GA census record listed a son Daniels age and {4} two of Daniel's children had Jane in their name. John Newby was listed in the 1820 Jasper Co, GA census with two boys, four women the oldest being between 16 and 25 years old, and a male over 45 years old. Two people were working in agriculture. John Nelson Newby lived in Jasper County Centells military district and drew a land lottery in 1820 in Irwin County (lot # 157 section 9). In the early 1830's he purchased 101 and 25 acres of land in district 17 Jasper County. He filed his will in the Jasper Co, GA courthouse recorded in Will Book 11 p 201 and following. He could not read. In the will he named his wife Jane and his four oldest children Nancy, Irene, Matilda and Larkin but not his four youngest children, who at that time were under age. He left $150 and land to each of the four oldest children and the other four would be given their inheritance when they became of age.12 Jane Newby was listed in the 1840 Jasper Co, GA census living with three males and two females, most likely sons and daughters. Her age was between 40 and 50 years old; therefore, she may have been John's second wife. Two people worked as farmers. One male was the right age to be their son Daniel. Children of John Newby and Jane are: i. Nancy R. Newby, married Cranford ii. Reney (Irene) Newby, married Randal Caps March 29, 1827 in Jasper Co, GA. iii. Matilda Newby, married Green iv. Buny Newby, married Randel Casser v. Olive Newby, married Daniel L. Jones December 23, 1841 in Jasper Co, GA. vi. Larkin Newby, born Abt. 1810; died 1874 in GA; married Winnifred Dodd in Jasper Co, GA; born Abt. 1815. Larkin won two Georgia land lotteries.7 In 1827 he lived in Jasper Co, GA, Owen District and won land in Lee County District 12. In 1832 he won land in Union or Lumpkin County District 11. He was listed in the 1840 Jasper Co and 1860 Monroe Co, GA censuses with wife Winny, Occupation laborer. They had no children that lived to be adults. His family buried him in the Cleland/Newby Cemetery in Jones Co, GA. He may have married Elizabeth Whitehead on November 12, 1871 in Monroe County. 2 vii. Daniel Jefferson (Jeff) Newby, born February 22, 1826 in GA; died February 15, 1882 in Jones Co, GA; married Sarah Elizabeth (Betsy) Cleland November 22, 1849 in Jones Co, GA. 6. William Robert Cleland, born Abt. 1805 in England; died March 1843 in Jones Co, GA. He was the son of 13. Annie Clark. He married 7. Nancy Glass. 7. Nancy Glass, born Abt. 1815; died January 28, 1874 in Jones Co, GA. She was the daughter of 14. Zachariah Glass and 15. Sarah (Sally) Wagnon. William was a very wealthy man who came from England to Charleston, SC and then to Georgia. A William Cleland was listed in the 1828 Monroe County Tax Digest with no land; the Jones County Deed Books N p 113 living in Jasper County in 1823 and Will Book Q p 81 1839 living in Jones County; and the Jones County Minute Book 1837 - 1854 p17 dated 5/12/1838. The 1840 Jones Co, GA census indicated he lived with his wife and four girls under ten. He owned 16 slaves with ten people working in agriculture. He and three of his children died in March of 1843 most likely from some disease. They and many of William's grandchildren were buried in the Cleland/Newby Cemetery in Jones Co, GA, which was part of his original estate. I could not find his will, but there are a number of records in the Record Book # L and others in the Jones Co, GA courthouse listing and distributing his estate which was extensive. The value of his slaves and personal property were $11,119.46. His wife and surviving three daughters received his property by lot.9,15 The only proof that I have that Nancy, wife of William, was the daughter of Zachariah Glass is a piece of paper in Z. Glass' estate on file in the Newton Co, GA courthouse stating the following "November the 4 - 1833 Rece (sic) of James Glass one of the adaminitrats (sic) of Zachariah Glass Dieced (sic) Three Hundred Dollars in part of said Estate from ???? By me one of the Legatees (sic) Wm Cleland." Reference number nine9 also indicates her maiden name was either Glass or Williamson. After William died she married Joseph Smith on October 24, 1844 in Jones Co, GA. She was listed in the 1850 and 1860 censuses living with her husband and his/hers/their children. She was listed as 35/45 years old in the 1850/60 censuses. Family legend49 claims she and her second husband separated. She was buried in the Cleland/Newby cemetery in Jones County. Her tombstone gives her date of death but not her birth. Children of William Cleland and Nancy Glass are: 3 i. Jesse Newby, died 1791 in Wilkes Co, GA. He was the son of 16. Thomas Newby and 17. Alice. He married 9. Keziah Tatom 1777. 9. Keziah Tatom, born Abt. 1750 in NC; died 1793 in Wilkes Co, GA. She was the daughter of 18. John Tatom and 19. Ann Wright. She married (1) Samuel Goodwin, born 1774 Granville Co, NC and died June 1821 in Wake Co, GA and (2) Jesse Newby. Jesse Newby was named in several wills as a purchaser of something from various estates during the period from 1773 to 1777 in Granville Co, NC (Granville Co, NC Book 1, p61, 62, 87, 138, 139). The family moved to Wilkes Co, GA in the early 1780's and he was on the tax list in Captain Pope's district in 1785. The family filed his will in Wilkes Co, GA as loose papers now on reel # 242-5 p1282 (Archives in Atlanta) and in the Wilkes County Will Book DD 1779 - 1792 p 92-4 with Abner Tatom appointed Adminstrator.12 The papers listed John Nelson Newby as his son and Jane as his daughter- in-law. Hezekiah Newby, born Abt. 1780 in NC; died Abt. 1822. iii. Larkin Newby, born Abt. 1782 in NC; died May 07, 1824; married Celia Pearce December 17, 1806 in Fayetteville, NC. Larkin was a merchant in Fayetteville, NC. During the 1810's he wrote to his friend Senator John W. Walter seeking help for his $20,000 debt problem. He partly blamed his brother J. N. Newby for $2000 of the debt. iv. Keziah Newby, born Abt. 1784 in NC; died November 27, 1809 in Fayetteville, NC. v. Henrietta Newby, born Abt. 1786 in NC; died 1819 in Fayetteville, NC; married Robert Raiford November 12, 1807 in Fayetteville, NC. 13. Annie Clark Child of Annie Clark is: 6 i. William Robert Cleland, born Abt. 1805 in England; died March 1843 in Jones Co, GA; married Nancy Glass 14. Zachariah Glass, born December 23, 1755 in Halifax Co, VA; died 1826 in Newton Co, GA. He was the son of 28. William Glass and 29. Joyce Daugherty. 15. He married (1) Nancy Williamson Abt. 1776. She died 1794. He married (2) 15. Sarah (Sally) Wagnon August 20, 1803 in Greene Co, GA. She was the daughter of 30. John Michael Waggonnan. He and his two older brothers each served in the Revolutionary War, and he and his brother William moved to Georgia around 1784. Both of the brothers became Lieutenants in the Georgia Militia. In 1785 Zachariah Glass Sr. and a Zachariah Glass were listed as members of the newly formed Phillips Mill Baptist Church in Wilkes Co, GA. In 1788 Zachariah still living in Wilkes Co, GA purchased 200 acres of land in Greene Co, GA and appeared to have moved into the county. In the late 1790's he and Joseph White [first husband of Zach's second wife] were both involved in the estate of John Michael Wagnon [Wagonman or Wagannon]. Z. Glass was involved in various land deals in Greene County [Greene County Deed Books]. In 1802 Zach, brother William and son Williamson obtained passports from the governor to go the Mississippi Territory. This group and others marshaled supplies and gathered intelligence for the up coming War of 1812 with England. In 1810 Zach published a notice that since Sarah "would not go with me" [to Alabama] that he was no longer responsible for her debts. In 1812 Zachariah built Fort Glass in Clarke Co, AL and over 1000 settlers came for protection. After the war he purchased land in Alabama and lived in Alabama but often traveled back and forth to Georgia. Zachariah died intestate before September 1826 in Newton Co, GA. There is an extensive file of his estate in the Newton Co, GA courthouse. The estate was not settled until 1847 because of court battles between his two families.44,45,46,47,50 The only proof that I have that Sarah was the daughter of John Michael Wagnon was that Capt. Joseph White, Sarah's first husband, applied for letters of Administration to John's estate. Zachariah Glass was involved in the estate as well.47 Joseph White's will was recorded in Greene County Will Book A/B p 302 and he listed his wife Sally and his children. He filed his will in Granville Co, NC 1798 and listed his surviving children and five grandchildren including Keziah Newby the daughter of his son Jesse12. Stevphen Wright and 39. Pembroke. John Tatom filed his will in Wilkes Co, GA courthouse. He divided his estate into nine equal parts to each living child or deceased child's children.12 Children of John Tatom and Ann Wright are: i.
