Carr and Stephen Renfroe Security We the Jury find for the plaintiff four hundred and thirty two dollars and twenty seven cents with interest and cost of suit. Oliver H. Morton, Foreman October 18, 1843 Sterling W. Smith Executor of Harrison Smith deceased Rule absolute to foreclose mortgage ~ vs John R. Carr Whereas this Court at the last Term there of did grant a Rule Ni Si directing the defendant to pay into the Clerk’s Office of this Court the principal and interest due upon a mortgage in said Rule Ni Si described together with the cost of said proceeding on or before the first day of this Court and that unless said sums of money be so paid that a Judgment would be given for said principal interest and costs in favor of the plaintiff Sterling W. Smith Executor as aforesaid against the said John R. Carr the mortgagor to be raised from said mortgaged premises and that said mortgaged property would sold in such manner as prescribed in case of execution and that the equity of redemption in and to said mortgaged premises be thence barred and foreclosed. And it appearing to the Court that said Rule Ni Si has been duly served on said John R. Carr the mortgagor and that he has failed to pay said sums of money so required. It is therefore adjudged considered and determined that the said Sterling Smith Executor of Harrison Smith deceased do recover of the said John R. Carr the sum of One Thousand and eight dollars for his principal, One hundred and four dollars and fifty cents interest to date due on said mortgage bearing date 15th day of December 1840 together with the cost of said proceeding to be levied and raised from said mortgaged premises to wit: Two tracts parcels or lots of land situate in Jones County to wit: ninety two and one half acres being part of lot number one hundred and forty four in the Eighth District of the original survey of Baldwin County and one hundred and forty seven and one half acres part of lot number not recollected situate in the Seventh District of said survey of Baldwin County now Jones and adjoining the first mentioned lot the whole adjoining lands of Powell Brown Bazemore and others and at the time of executing said mortgage in the occupancy of James Long and in the day and year aforesaid said premises were conveyed to said John R. Carr by the said Sterling W. Smith.
