All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Deppner http://www.genrecords.net/emailregistry/vols/00012.html#0002870 March 16, 2007, 12:13 am Part of Lot 8 and part of fraction Lot 3, First District Written: November 3, 1840 Recorded: November 16, 1840 Jones County, Georgia Deed Book Q, page 91 Georgia, Jones County Whereas the Inferior Court of the county of Baldwin when sitting for ordinary purposes on the ___ day of _____ in the year Eighteen hundred and thirty nine upon the application of Lemons Box and Benjamin Cobb Administrators of the Estate of Daniel Cobb deceased did pass an order for the sale of the real estate of said deceased hereinafter described, (legal notice of such application having been first given in one of the public Gazettes of this State, to wit, in the Standard of Union for four months previous to the granting of the order aforesaid;) and whereas the said Lemons Box and Benjamin Cobb administrators as aforesaid, (having first given sixty days notice of said Sale and of the time and place thereof, in the public Gazette aforesaid; and at the door of the Court House in said county,) did on the third day of November in the year eighteen hundred and forty at the place of public sales, in the county of Jones aforesaid expose to Sale at public auction, under and by virtue of the order aforesaid, the premises hereinafter mentioned; And whereas the said premises were then and there knocked off to James May (who was the highest bidder for the same) at and for the sum of three hundred dollars, Now this indenture made the third day of November in the year eighteen hundred and forty, and in the 65th year of the Independence of the United States of America, between the said Lemons Box of the County of Randolph and Benjamin Cobb of the County of Wilkinson and State aforesaid administrators as aforesaid, of the one part, and James May of the County of Jones and State aforesaid of the other part; Witnesseth, that the said Lemons Box and Benjamin Cobb administrators as aforesaid, for and in consideration of the sum of three hundred dollars to them in hand paid, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged hath granted, bargained, sold, aliened, conveyed and confirmed, and by these presents doth grant, bargain, Sell, alien, convey and confirm unto the said James May his heirs and assigns All those two parcels or parts of lots of land supposed to contain in the aggregate two hundred acres, more or less, Situate lying and being in the County of Jones known as all of that part of lot number eight in the first district of originally Baldwin County, which now lies in the County of Jones, and a part of fraction number three in said first district of originally Baldwin now Jones County, being a part of the real estate of the said Daniel Cobb deceased, adjoining the Baldwin County line and lands of James May in Jones County and others. To have and to hold, the said bargained premises, with all and singular, the rights, members and appurtenances thereof whatsoever, to the said premises being belonging or in any wise appertaining, with the remainders, rents, issues and profits thereof, to the only proper use, benefit and behoof of him the said James May his heirs, executors, administrators and assigns in fee Simple. And the said Lemons Box and Benjamin Cobb administrators as aforesaid their heirs executors and administrators the said bargained premises unto the said James May his heirs executors, administrators and assigns, against all persons claiming by, from or under the said Daniel Cobb deceased, or the said Lemons Box and Benjamin Cobb administrators as aforesaid and all other persons whatsoever, shall and will forever warrant and defend by virtue of these presents. In witness whereof the said Lemons Box and Benjamin Cobb administrators as aforesaid hath hereunto set their hands and affixed their seals the day & year last above written.
