Hardeman did make to Daniel Scott in his lifetime a contract in writing conditioned to make to said Daniel Scott a deed of conveyance to certain lands hereinafter mentioned upon the payment of fee in facias which issued from the Superior Court of said county in favor of Warren Jordan against said Daniel Scott transferred to said Robert V. Hardeman and whereas said fee in facias has been satisfied & the said Daniel Scott having departed this life before the title to said land was made and whereas the Court of Ordinary of said county did this day pass an order directing said Robert V. Hardeman to make title for said land to the heirs general of the said Daniel Scott deceased. Now this indenture witnesseth that in consideration of the premises and the payment of said fi fa amounting to six hundred & eighty-seven dollars & fifty cents principal, one hundred twenty-six dollars & eighty-one cents interest to judgement besides cost and the subsequent interest accruing whereon the said Robert V. Hardeman does by these present bargain and sell unto the heirs general of the said Daniel Scott all that tract or parcel of land containing three hundred and seventy eight acres more or less and being the place whereon said Daniel Scott resided at & before his death adjoining land of Benjamin Barron, William Whatley and Harris Gresham and being the lands deeded by Warren Jordan to said Robert V. Hardeman on the 17th day of March 1841 except 80 acres thereof lying on the East side of the old road leading from Clinton to Monticello when it was deeded by Hardeman to Benjamin Barron on the 10th day of December 1841. To have and to hold the said bargained premises unto the said heirs general of the said Daniel Scott deceased their heirs and assigns forever in fee simple. And the said Robert V. Hardeman doth by these warrant the title to said lands unto the said heirs general of Daniel Scott deceased and will forever defend the same free from the claims of all other persons whatever. In testimony whereof the said Robert V. Hardeman has hereto set his hand & seal this the 6th day of May 1850. Signed sealed & delivered Robert V. Hardeman (his seal) in the presence of Gilbert E.
