Hensler of the County and State aforesaid of the one part and John Martin of the same place. Witnesseth that the said John P. Hensler hath this day made and delivered to the said John Martin said promissory notes subscribed his and bearing even date with these presents. Whereby the said John P. Hensler hath promised to pay the said John Martin or bearer Seventeen hundred and forty two dollars on or before the first day of February next owing the date hereby for value received. I now for and in consideration of the sum of Seventeen hundred and forty two dollars by the said John Martin the said John P. Hensler in hand paid the receipt whereof & hereby acknowledged as well for the better securing the payment of the aforesaid promissory note the said John P. Hensler hath granted bargained and sold and doth by these presents grant bargain and sell unto the said John Martin his heirs and assigns four Negroes Viz ~ Mahala a black woman about twenty seven years old and her two children Kire a boy about nine years old and Ann a girl about five years old a Malatta, and Hawson a boy about nineteen years old black & also a tract of land containing Two hundred two & a half acres called and known by the mane of the May Tract adjoining said Martin, Sterling Lanier, Richard Hensler and others. To have and to hold said bargained Negroes and land to the said John Martin his heirs & assigns to his and their own proper use benefit and behoof forever. And to the said John P. Hensler for himself his heirs executors & administrators the said bargained Negroes and lands unto the said John Martin will warrant and forever defend against the claim of himself and his heirs and against the claims of all other persons whatsoever provided never the less that if the said John P. Hensler his heirs executors and administrators shall and to well and truly pay or cause to be paid unto the said John Martin his heirs and assigns the aforementioned sum of seventeen hundred and forty two dollars on the day & time mentioned and appointed for the payment thereof in the said promissory note mentioned with lawful interest for the same according to the tenor of said note then & from thence forth as well this indenture. And the rights of the property thereby conveyed as the said promissory note shall cease determine and be void & to all intents and purposes. In testimony whereof the said John P.
