Witnesseth that the said Benjamin May Guardien aforesaid for and in consideration of the sum of one thousand Dollars in hand paid at and before the Sealing and delivering of these presents the receipt whereof is hereby acknowledged hath granted bargined Sold aliened Conveyed and Confirmed and by these presents do grant bargin Sell alien Convey and Confirm unto the Said James Smith his heirs and assigns all that tract piece or parcel of land Containing forty five acres more or less being part of lot number one in the tenth district of formerly Baldwin now Jones County and belonging to the Said Lewis Willis & Cammel Burton orphants [sic] of John Burton deceased the Said Benjamin May being duly appointed their guardiaen and having legally obtained leave from the Court of ordinary of Said County and the Said tract of land being legally advertised for Sail [sic] at Clinton on the first tuesday of this month the same was accordingly on that day & betwen lawful hours set up & Exposed to publick Sale and outcry when the Said James Smith being the highest and best bidder the Same was knocked off to him for the sum of money aforesaid the description of Said tract of land will now fully appear by referrence to a plat of the Same hereto annexed. To have and to hold the Said tract of land with all and Singular the rights members and appurtinances thereof whatsoever to the Said tract of land being belonging or in any wise appertaining with the remainders and remainder, reversions or reversion, rents issues and prophits thereof to the only propper use benefit and behoof of him the Said James Smith his heirs Executors administrators and assigns in fee Simple and the Said Ben'n May Gardian from Said orphans and their heirs Executors and administrators the Said bargined tract of land unto the said James Smith heirs executors and administrators and all and evry other person or persons Shall and will warrant and forever defend by virtue of these presents. In Witness Whereof the Said Benj'n May Guardian hath here unto Set his hand and affixed his Seal the Day and year first abov writen. Additional Comments: FHL film #0470016 From Jones County Court Records, 1814-1815, page 60: Lewis Burton an orphan of John Burton dec'd being of lawful age came into Court & makes choice of Benjamin May his guardian & he is hereby appointed and the Court further appoints the said Benjamin May guardian of the persons & Estate of Willis Burton & Cammel Burton, the other orphans of said deceased, they being under the age of fourteen years, on his giving the necessary bond & security.
