Smith from Sterling W. Smith This indenture made this thirty first day of January in the year of our Lord eighteen hundred and fifty four between Sterling W. Smith of the one part and John I. Smith of the other part, both of said County and State. Witnesseth that whereas said Sterling W. Smith and John I Smith did on the seventh day of December in the year Eighteen Hundred and Fifty-two make & deliver to Sarah Childs his certain promissory note subscribed within these presents. Whereas twelve months after date hereof the said Sterling W. Smith and John I. Smith jointly and severally (Together the two or either of us) promised to pay said Sarah Childs, executrix of the estate of Joseph Childs, deceased, twenty six hundred & seventy five dollars for value received and the sum being the proper debt of him the said Sterling W. Smith and the said John I. Smith living security on the said note for the said Sterling W. Smith & which security he became at the instance and request of the said Sterling W. Smith. Now for & in consideration of the sum of five dollars by the said John I Smith to the said Sterling W. Smith in hand paid at or before the delivery of these presents, receipt whereof is hereby acknowledged as well as for the better securing & will indemnify the said John I. Smith from all loss injury & damage on account of his relationship on said promissory note the said Sterling W. Smith hath granted bargained & sold and doth by these presents grant bargain & sell unto the said John I. Smith his heirs & assigns the following lands & Negro slaves. All that land or parcel of land situate in said County on the waters of Walnut Creek containing four hundred & seventeen acres more or less being the place whereon the said Sterling W. Smith now lives adjoining lands of James A. Billingslea and the estate of of Stephen Clower and Elbert & Sarah Hutchings four hundred fourteen acres of said land were purchased by the said Sterling W. Smith of John W. Brantley, Horatio L. Brantley & Joseph T. Branley, the other three acres were purchased by the said Sterling W. Smith of George W. F. McKay. Negro man named Washington about forty years old, Negro man man named Step(?) about forty five years old, Negro boy named Pony about eighteen years old and a Negro boy named Eli about fourteen years old to have & to hold the said bargained lands & Negro slaves unto him the said John I. Smith forever & the said Sterling W. Smith for himself his heir executors & administrators, the said bargained lands & Negro slaves to the said John I. Smith his heirs & assigns will warrant and forever defend against the claim of himself & his heirs & against the claim of all other persons. Provided nevertheless that if the said Sterling W. Smith his heirs executors and administrators shall will & truly pay the said sum specified in said promissory note with all lawful interest on the land & shall at all times hereafter save harmless & indemnify the said John I. Smith & assigns from loss injury or damage on account of his relationship on said promissory note then & from henceforth as well this presents in and the right to the property hereby conveyed shall deem, determine and be void and to all intents & purposes. The said lands & Negro slaves and the same this day & at this present instance of him conveyed & mortgaged by the said Sterling W. Smith to Robert V. Hardeman of said County the security for the said Sterling W. Smith on a note made on the nineteenth day of January in the year eighteen hundred & fifty three to James G. Barnes administrator of the estate of Joseph Chesser, deceased for one thousand & seventy dollars, and twelve months after the date thereof the said conveyance & mortgage to the said Robert V. Hardeman to have the like lien on said property as this conveyance & mortgage and the said debt for which the said Robert V. Hardeman is security for the said Sterling W. Smith is to ___ & be paid ___ out of said ____ with the debt for which the said John I. Smith is the security for the said Sterling W. Smith as before mentioned. In witness whereof the said Sterling W. Smith hath hereby set his hand & seal the day & year first above written Sterling W. Smith to Robert V. Hardeman Sterling W. Smith and Robert V. Hardeman did on the 19th day of January 1853 make & deliver to James G. Barnes their promissory note. Twelve months after date they promised to pay James G. Barnes, Administrator on the Estate of Joseph Messer or bearer $1,000 security for value received. Robert V. Hardeman being security on note for Sterling W. Smith. Hardeman paid $5.00 to Sterling W. Smith for land on the waters of Walnut Creek containing 417 acres, which is where Sterling W. Smith now lives. Adjoining lands of James A. Billingsea and the estate of Stephen Clower and Elbert and Sarah Hutchings. 414 acres were purchased by Sterling W. Smith of John W. Brantley, Horatio L. Brantley and Joseph H. Brantley. The other three acres were purchased by Sterling W. Smith of George W. McKay. A Negro man named Washington about 44, a Negro man named Stepny about forty five, a Negro boy named Perry about eighteen and a Negro boy name Eli about fourteen. The said 417 acres and Negro slaves are the same this day & at this time present instance of time conveyed & mortgaged by the said Sterling W. Smith to John I. Smith of said County the security for the said Sterling W. Smith in a note made on the 17th day of December, 1852 to Sarah Child Executrix on estate of Joseph Childs, deceased for $2675 due 12 months after date thereof. The said conveyance & mortgage to the said John I. Smith to have the like lien on said property as this conveyance & mortgage and the said debt for which the said John I. Smith is security for the said Sterling W. Smith is & shall to be paid ___ out of said property with the debt for which the said Robert V. Hardeman is the security for the said Sterling W. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker of the other part, all of said County and State. Witnesseth that whereas the said Sterling W. Smith and the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker did on the second day of January in the year eighteen hundred and fifty five, make and deliver to Frances S. Johnson their certain promissory note subscribed with their hands, whereby on or before the twenty fifth day of December next the said Sterling W. Smith, Daniel N. Smith, Joseph L. Barnes Guardian of the minors of Joseph Messer, deceased, or bearer the sum of twelve hundred and twenty two dollars and fifty one cents for value received. And also did on the second day of January in the year eighteen hundred and fifty five make and deliver to one Taylor F. Gibson their certain promissory note subscribed with their hands, whereby on or before the twenty fifth day of December next, the said Sterling W. Smith, Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker jointly and severally, written we or either of us, promised to pay Taylor F. Gibson or bearer the sum of five hundred and fifty eight dollars and forty eight cents for value received. And did also on the second day of January eighteen hundred and fifty five make and deliver to one Sarah Chiles their certain promissory note subscribed with their hands, whereby on or before the twenty fifth day of December next, the said Sterling W. Smith, Daniel N. Smith, Joseph S. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker jointly and severally, written we or either of us, promise to pay Sarah Chiles, Executrix of the Estate of Joseph Chiles, deceased, or bearer the sum of seven hundred and thirty three dollars and thirty nine cents for value received. And also on the second day January in the year eighteen hundred and fifty five, make and delivered to one Taylor F. Gibson their certain promissory note subscribed with their hands, whereby by the twenty fifth day of December next, the said Sterling W. Smith, Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker jointly and severally, written we or either of us, promised to pay Taylor F. Gibson or bearer the sum of forty eight dollars and eighteen cents for value received. And also did on the second day of January in the year eighteen hundred and fifty five make and deliver to one Richard H. Hutchings their certain promissory note subscribing with their hands whereby one day after date thereof the said Sterling W. Smith, Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker jointly and severally, written we or either of us, promised to pay Richard H. Hutchings or bearer the sum of one hundred and sixty one dollars and eighty four cents for value received. And these several above mentioned notes being the proper debt of Sterling W. Smith and the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker being security on said notes for the said Sterling W. Smith and which security and which security they became at the instance and request of the said Sterling W. Smith. Now for and in consideration of the sum of five dollars by the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John S. Walker and John I. Smith to the said Sterling W. Smith in hand paid at and before signing sealing and delivering of these presents, receipt whereof is hereby acknowledged, as well as for the better securing and indemnifying the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James a. Billingslea, William S. Moughon, John I. Smith and John S. Walker from all loss, injury and damages on account of their suretyship on said promissory notes. The said Sterling W. Smith hath granted, bargained and sold and doth by these presents grant, bargain and sell unto the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker their heirs and assigns the following Negro Slaves to wit: a Negro man named Stepny about forty years old, a Negro man named Washington about thirty eight years old, a Negro woman named Ann about thirty five years old, a Negro woman Kitty about twenty five years old, a Negro boy named Perry about sixteen years old, a Negro boy named Eli, about fourteen years old, a Negro girl name Ruth Ann about fourteen years old, a Negro girl named Hannah about twelve years old, a Negro girl named Mary about ten years old, a Negro child named Ben about six years old, a Negro child named Martha about four years old, and a Negro child named John about two years old. To have and to hold the said Negro slaves unto them the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel s. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker, their heirs and assigns, will forever warrant and defend against the claim of himself and his heirs against the claim of all other persons whatever.
