Smith & John S.Walker Book S, Pg. 78 January 6, 1855 Deed to Secure Debt Twelve Negro Slaves This indenture made this the sixth day of January in the year of our Lord, eighteen hundred and fifty five between Sterling W. Smith of the one part and Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker of the other part, all of said County and State. Witnesseth that whereas the said Sterling W. Smith and the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker did on the second day of January in the year eighteen hundred and fifty five, make and deliver to Frances S. Johnson their certain promissory note subscribed with their hands, whereby on or before the twenty fifth day of December next the said Sterling W. Smith, Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker jointly and severally, we or either of us, promise to pay Francis S. Johnson or bearer the sum of six hundred and thirty nine dollars and fifty one cents for value received And also did on the second day of January in the year eighteen hundred and fifty five make and deliver to James G. Barnes their certain promissory note subscribed with their hands whereby twelve months after date thereof the said Sterling W. Smith, Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John S. Walker and John I. Smith jointly and severally, written we or either of us, promised to pay James G. Barnes Guardian of the minors of Joseph Messer, deceased, or bearer the sum of twelve hundred and twenty two dollars and fifty one cents for value received. And also did on the second day of January in the year eighteen hundred and fifty five make and deliver to one Taylor F. Gibson their certain promissory note subscribed with their hands, whereby on or before the twenty fifth day of December next, the said Sterling W. Smith, Daniel N. Smith, Joseph L. Holland, Leroy Singlton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker jointly and severally ,written we or either of us, promised to pay Taylor F. Gibson or bearer the sum of five hundred and fifty eight dollars and forty eight cents for value received. And did also on the second day of January eighteen hundred and fifty five make and deliver to one Sarah Chiles their certain promissory note subscribed with their hands, whereby on or before the twenty fifth day of December next, the said Sterling W. Smith, Daniel N. Smith, Joseph S. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker jointly and severally, written we or either of us, promise to pay Sarah Chiles, Executrix of the Estate of Joseph Chiles, deceased, or bearer the sum of seven hundred and thirty three dollars and thirty nine cents for value received. And also on the second day January in the year eighteen hundred and fifty five, make and delivered to one Taylor F. Gibson their certain promissory note subscribed with their hands, whereby by the twenty fifth day of December next, the said Sterling W. Smith, Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker jointly and severally, written we or either of us, promised to pay Taylor F. Gibson or bearer the sum of forty eight dollars and eighteen cents for value received. And also did on the second day of January in the year eighteen hundred and fifty five make and deliver to one Richard H. Hutchings their certain promissory note subscribing with their hands whereby one day after date thereof the said Sterling W. Smith, Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker jointly and severally, written we or either of us, promised to pay Richard H. Hutchings or bearer the sum of one hundred and sixty one dollars and eighty four cents for value received. And these several above mentioned notes being the proper debt of Sterling W. Smith and the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker being security on said notes for the said Sterling W. Smith and which security and which security they became at the instance and request of the said Sterling W. Smith. Now for and in consideration of the sum of five dollars by the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John S. Walker and John I. Smith to the said Sterling W. Smith in hand paid at and before signing sealing and delivering of these presents, receipt whereof is hereby acknowledged, as well as for the better securing and indemnifying the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James a. Billingslea, William S. Moughon, John I. Smith and John S. Walker from all loss, injury and damages on account of their suretyship on said promissory notes. The said Sterling W. Smith hath granted, bargained and sold and doth by these presents grant, bargain and sell unto the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker their heirs and assigns the following Negro Slaves to wit: a Negro man named Steph__about forty years old, a Negro man named Washington about thirty eight years old, a Negro woman named Ann about thirty five years old, a Negro woman Kitty about twenty five years old, a Negro boy named Perry about sixteen years old, a Negro boy named Eli, about fourteen years old, a Negro girl name Ruth Ann about fourteen years old, a Negro girl named Hannah about twelve years old, a Negro girl named Mary about ten years old, a Negro child named Ben about six years old, a Negro child named Martha about four years old, and a Negro child named John about two years old. To have and to hold the said Negro slaves unto them the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel s. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker, their heirs and assigns, will forever warrant and defend against the claim of himself and his heirs against the claim of all other persons whatever. Provided, nevertheless that if the said Sterling W. Smith, his heirs, executors and administrators shall ___and truly pay the said sums of money specified in said promissory notes with all lawful interest on the same and shall at all times hereafter save harmless and indemnify the said Daniel N. Smith, Joseph L. Holland, Leroy Singleton, Nathaniel S. Glover, James A. Billingslea, William S. Moughon, John I. Smith and John S. Walker and keep them from all loss, injury and damage on account of their suretyship on said promissory notes, then and from thenceforth as well , this present, indenture and the right to the property thereby conveyed, shall cease, determine and be void to all intents and purposes.
