Tyson Grantee Daniel Rosser (Roper) Dec 1 '21 – Nov 21, '22 100a Georgia Jones County } This Indenture Made this first day of December in the Year of Our Lord One thousand eight hundred and twenty one, between Kintchen P Tyson of the County & state aforesaid of the one part and Daniel Roper of the same place of the other part. Witnesseth the said Kintchen P Tyson hath this day made & delivered to the said Daniel Roper his certain promisory note Subscribed with hand & bearing date with those ?promises whereby the said Kintchen P Tyson hath promised to pay the said Daniel Roper or bearer Seven Hundred & fifty dollars on the 25th day of December 1823 for Value received Now for and in Consideration of the sum of Five dollars by the said Daniel Roper to the said Kintchen P Tyson in hand paid the receipt whereof is hereby Acknowledged as well as for the letter securing the payment of the aforesaid promisory note(s) the said Kintchen P Tyson hath granted bargained & sold & doth by these presents grant, bargain, sell & Convey Unto the said Daniel Roper his heirs & assigns all that tract or parcels of Land situate lying & being in the County aforesaid but in the County of Bladwin at the time of Survey on the waters of Commissioners creek Containing One hundred Acres it being a part of a 202 ½ acres tract originally granted to Jas S Lynar ______the said Kintchen P Tyson to have & to hold said bargained promises to the said Daniel Roper his heirs & assigns to him & their own proper Use benefit & beha__F forever And the said Kintchen P Tyson for himself his heirs executives and administrators the said bargained promises hereto the said Daniel Roper ______warrant and forever defend against the claim of himself and his heirs and Against the Claim of all other persons whatsoever provided Nevertheless that if the said Kintchen P Tyson his heirs executors & adminis. shall do well and truly pay or Cause to be paid Unto the said Daniel Roper his heirs and assigns the aforesaid mentioned sum of Seven hundred & fifty dollars on the day and time Mentioned & appointed for the payment thereof in the said promisory notes mentioned with lawful intent for the Same according to the tenor of said notes then & from thence as well as this present indenture & the right to the property thereby Convey 'p as the said Promisory notes shall con?. & be void to all purposes, in testimony the day & Year above written.
