Herman Mercer's Co., GA Militia Wid. Orig. 12250 Wid Certf. 17873 State of Alabama, Co. of Randolph In the matter of pension claim of Lydia Scott widow of Daniel Scott of (Wilkes)? personally came before me, a clerk of this circuit court in and for county and state, Gustavus Scott aged fifty one years and his wife Ruthy M. Scott aged forty years citizens of the county of Cleburne and state of Alabama and who being duly sworn declare as follows: That they are son and daughter in law of Lydia Scott the applicant and that the claimant resides with them that she is totally blind and helpless and bring up that they know that Daniel Scott is dead that he died in Jones county in the State of Georgia on or about the 18th day of February 1849. They were present at his death and know that he died and is buried at Harpers Graveyard in Jones County Georgia and know that the applicant Lydia Scott has not been married since his death - that the applicant has lived in the house with them for twenty five years last passed and has been blind fourteen years last passed. They further state that she is the widow of Daniel Scott deceased who was a private in Captain Mercers Company of the Georgia Militia War 1812- that she, the said Lydia Scott since she began to live with affiants has as the widow of the said Daniel Scott deceased applied for and received two 80 acre land warrants for the above named service of her late husband Daniel Scott. They further state that they have no interest in said claim further than the welfare of their mother and mother in law Lydia Scott as she is without means to support herself. Scott aged about fifty six years a resident of Tallapoosa County in the state of Alabama. ____________________________________________________________________________________ _________________________________________________________ General Affadavit in the matter of Pension claim of Lydia Scott widow of Daniel Scott NO. 12250 State of Alabama, County of Tallapoosa Personally came before me a Judge of the Probate Court, John Scott aged 48 years citizen of county of Tallapoosa State of Alabama who being duly sworn declares as follows: That he is a son of Daniel Scott and the above name applicant Lydia Scott and that his father, Daniel Scott, died in Jones County in the state of Georgia on or about the 18th day of February 1849 that he saw his father Daniel Scott die and that his mother obtained two 80 acre land warrants for the service of his father Daniel Scott for his services in the Georgia Militia in the War 1812- he further states that his mother Lydia Scott is still a widow that since the death of his father she has never been married - that she is now quite old and totally blind and without means ------- General Affadavit of Gustavus Scott aged fifty years, son of applicant Lydia Scott that he is the ninth child of Daniel Scott dec'd and Lydia Scott, applicant and that he was born on the 18th day of June 1827- that his father Daniel Scott dec'd told him on the 18th day of June 1848 that he was his own man to do for himself, and that at an election for President of the United States in the year 1848 in November of that year at Clinton in Jones County GA he cast his first vote for Gen Taylor for President of the United States - he states further that he has two children married has three grown children - affiant states that he has reason to believe from the number of children of his parents Daniel and Lydia Scott that are older than he is that they must have been living together as husband and wife as far back as 1812 or 1813 - affiant further states that he has frequently heard his mother speak of going to where his father Daniel Scott was at military camps and staying with him that she and him was just married a short time before the said Daniel Scott, affiants father went into the War 1812. - that Daniel Scott affiants father frequently said that he was married just a short time before he went into the service and its some 29 years since his father's death. General Affadavit of Micajah Davis age 85 and Baxter B. Davis age 81 of Randolph Co., Alabama That they both resided in Wilkes Co. GA in the year 1812 when the war began. Micajah Davis states he was then about 17 yrs old and Baxter B. Davis states he was about 15 years at the commencement of the War 1812. That they then lived within a few miles of Daniel Scott and Lydia Scott and knew that they lived together as husband and wife prior to Daniel Scott going into the war and their best recollection is that Mrs Lydia Scott's first child was born while Daniel Scott was in the war that they know that her maiden name was Lydia Gamage that they know the Gamage family well and also the Scott family and that if Daniel Scott and the said Lydia Gamage were not legally married they never heard of it ----------- Declaration of a Widow for Pension Randolph Co., Alabama 27 April 1877 Lydia Scott age 85 resident Cleburne Co., Alabama she declares she is the widow of Daniel Scott who served the full period of sixty days in the military service of the U.S. in the War of 1812 and who was the identical Daniel Scott who volunteered in Cap't (probably) Littles Co. at Washington, GA on Dec. 1812 or 1813 and was honorably discharged at Fort Hawkins GA on Dec 1813 or 1814 - she states that her husband has frequently told her that he was not in any battles but that he was an invalid all the time that she was married under the name of Lydia Gamage to Daniel Scott on the 20th January 1812 by James (Chivens)?, J.P. at the house of her father - that her said husband died at or near Clinton, GA on the 18th day of February 1848 and that she has not remarried and that her domicile or place of abode is now at or near Chulafinee, Cleburne Co. Alabama. Pensioner Dropped I hereby report that the name of Lydia Scott widow 9 Mar 78 Certificate No. 17873 who was last paid $8 to 30 Nov. 1880 has been dropped because of death, Pd Gustavus Scott on R. W. from 4 Sept 80 to 30 Nov 80 Amnt. $23.20.
