Marital Agreement Between John Pitts and Lucy C. Pitts who was Lucy C. Williams of Said county. And whereas previous to said intermarriage it was agreed by and between the said John Pitts and Said Lucy C. that the property which the Said Lucy C. had and owned before said intermarriage then one individual one fourth interest in the estate of her former husband Howel F. Williams late of Said county deceased. Which said property has since Said intermarriage been assigned and Set apart to the said John Pitts and consists of Three negroes named Lewis Edmund and Adaline Tow [sic] Bouroes a half dozen Flag Chairs one Bed, Bedstead and furniture one couch one work Stand and promisory notes amounting to Eleven hundred and Twenty dollars and twenty one cents and yet an undevided one fourth interest in a house and lot in which Said Lucy resides before and at the time of said intermarriage Should not become the property of him the Said John Pitts absolutely but that in the event that Said marriage Should be had and Solemnized between the Said John Pitts and Lucy C. that Said John Pitts would hold and control the said property for and during the joint lives of the Said John Pitts and Lucy C. for his own use and benefit not to be accountable for the hire of Said negroes their earnings and gains or the interest on Said notes or the rent of Said interest in said house and lot and in the event that the said Lucy C. Shal[sic] Servive the Said John Pitts and in that event the said negroes with the natural increase of said female slave said house hold furniture the amount of the principel of said promisory note and the individual interest in said house and lot should be absolutely the property of the said Lucy C. at the death of him the said John Pitts and in the event that the said John Pitts Should Servive the said Lucy C. then and in that event and at the death of the said Lucy C. the said negroes furniture the amount of the principel of Said promisory notes and the undevided interest in Said house and lot and the natural increase of Said female Slave Shall be the property of James D. Williams Howel Flewellen Williams Thomas Jefferson Williams children of the said Lucy C. And it was agreed on the part of the Said Lucy that she is not to claim dower or a distributive Share in the estate of the Said John Pitts in the event that She Should Servive him. Now in consideration that said marriage having had & solemnized and in consideration of the promises the said John Pitts does hereby acknowledge that he holds and possesses said negroes furniture promisory notes and the undevided interest in said house and lot as trustee subject to the foregoing Stipulations and agreement entered into before said intermarriage. And the said John Pitts covenants to and with the said Lucy C. that in the event that She should Servive him that She the said Lucy C. shall have said negroes furniture and the amount of the principel of said promisory notes and the undevided interest in said house and lot with the natural increase of said female Slave at the death of him the Said John Pitts as her own property and right absolutely and Should said principel of Said notes be used by me the amount thereof is to be raised from my Estate And the Said John Pitts covenants to and with the said James D. Williams Howel Flewellen Williams & Thomas Jefferson Williams that in the event that the said Lucy C. shall depart this life before the death of him the said John Pitts that at her death he the said John Pitts will convey and deliver said negroes furniture the amount of the principel of the said promisory notes the undevided interest in said house and lot and the natural increase of the female slave unto them the said James D. Williams Howel Flewellen Williams and Thomas Jefferson Williams absolutely and forever. And the Said Lucy C. for the purpose of carrying out said agreement entered into before said intermarriage as before expressed into effect in consideration of the promises of the said marriage agreement hereby covenants to and with the said John Pitts his heirs Executors and administrators that in the event that she shall Servive the said John Pitts then of the heirs Executors and Administrators of him the said John Pitts at his death shall deliver said negroes furniture the amount of the principel of Said promisory notes the undevided interest in Said house and lot with the natural increase of the female Slave then and in such event she the said Lucy C. is not to claim dower in the lands of said John Pitts nor any distributive interest in his estate.
