I also give and bequeath to my said wife Sarah the following personals to wit: Four Negroes, Jack, Henry, Mary & Betty, and the increase of said Mary & Betty that may be hereafter born - Two mules or horses or one of each of her own selection- All the Cattle, Hogs, and Sheep, Plantation or farming tools Household and Kitchen furniture, cooking utensils, Provisions corn and fodder oats and grain that I may be in possession of at my decease which she may need or desire to keep for the use of herself and negroes, but not in any other manner to be disposed of - to use occupy & enjoy during her natural life. Iten 2nd: Having given to my SON WILLIAM P. CARSON and to my son in law John H. Thomas who married my DAUGHTER ISABELL each an amount of property which I consider equal to a share of what I have at this time to dispose of to my remaining children (which gifts I now confirm) I therefore will and desire that they have nothing further out of my estate either real or personal. Item 3rd: I give to my SON JOHN P. CARSON two negroes to wit, Augustus and William to him and his heirs forever. Item 4th: I give and bequeath to my SON DAVID P. CARSON two negroes Edenbury and Bill, to him and his heirs forever. Item 5th: I give and bequeath to each of my grand children the children of my deceased DAUGHTER MALINDA BRANTLEY that may be then living (at the time of my death) the sum of One hundred dollars in money - to be paid by my Executors to such of said grand children as may be of age or married Six months after my decease to such grand children as may then be minors or unmarried to be paid so soon as they shall severally arrive at the age of twenty one years or marry to them and their heirs forever. Item 6th: It is my will and desire that all the remainder and residue of my property either real or personal not disposed specially in this legacy and such of the personal property given to my wife in the first item be sold at public sale by my Executors and the proceeds thereof after paying my just debts and the several legacies contained in the fifth item, be equally divided between my seven children, or their representatives to wit, JAMES JONES wife of John Jones, THOMAS J. CARSON, ADAM CARSON, JAMES J. CARSON, JOSEPH J. CARSON, JOHN P. CARSON and DAVID P. CARSON to them and their heirs forever. Item 7th: After the death of my wife Sarah, it is my will and desire that all the property herein given to her and the increase of the negroes, Stock, Cattle and Sheep be sold at public sale to the highest bidder by my executors and the proceeds thereof to be divided share and share alike between my said seven children named in the sixth item of this my will to them and their heirs forever. Lastly, I nominate and appoint my SONS THOMAS J. CARSON, DAVID P. CARSON and JOHN P. CARSON My Executors to carry this my will into effect. And I hereby revoke and declare to be null and void all other wills by me heretofore made in testimony whereof I have her unto set my hand and affixed my seal this the SIXTEENTH DAY OF JUNE IN THE YEAR OF OUR LORD, ONE THOUSAND EIGHT HUNDRED AND FORTY ONE. Pitts, three of the Justices of the Inferior Court of the said county in person came Daniel McCloud one of the subscribing witnesses to within instrument of writing and being duly sworn, deposeth and saith that he saw ADAM CARSON the testator sign publish and declare the within instrument to be and contain his last will and testament and that testator was of sound and disposing mind and memory at the time of executing the same and deponent subscribed the same as a witness, together with William G. Smith and William Brewer at testator's request and his presence and in the presence of each other. Daniel McCloud Sworn to and subscribed before US this 22nd DAY FEBRUARY 1853 Peyton T. Pitts, J.I.C. NOTE: I suspect that the name of the daughter married to John Jones was incorrectly written by the court clerk who transcribed the will into the court record book.
