Comer LComer@houston.rr.com ==================================================================== JONES COUNTY, GEORGIA, RECORD OF WILLS TRANSCRIBED FROM BOOK A 1809-1815, BOOK B 1815-1825, BOOK C 1826-1856, PAGES 236-239 (originally in Will Book C) Office of the Probate Judge of Jones County, Georgia Georgia Jones County } I William Flewellen of said State and county being of sound mind and disposing memory but in ill health & knowing that it is appointed for all men to die, do make, publish and declare this my last will and testament, in manner and form following to wit,. First I will that my present crop of cotton now growing be sold by my Executors hereinafter named for the purpose of paying my debts and should there be a deficiency all of my hands are to be left and worked upon my farms for the purpose of making another crop and my other cotton crop to be sold for paying my debts and should there be a surplus over paying my debts from the present or other crop of cotton to be made said surplus to be equally divided between my wife and all my children and until my debts are paid my wife and children are to be equally supported and my children educated out of the whole of my properties. The corn and other provender and provisions to remain for a general support of my family and stock unless there should be a surplus and in that event said surplus to be sold and equally divided between my wife and all of my children, and any and all other property not herein willed away is to be equally divided between them. Second - I give and bequeath to my beloved wife Mary Flewellen all my land situate lying and being in the county of Jones and State aforesaid to her and her heirs forever in fee simple with the exceptions of my Houses and Lots in the town of Clinton which said Houses and Lots in the town of Clinton aforesaid my wife is to have the possession use and occupancy of so long as she may think fit to retain the possession use and occupancy thereof free from any charge or rent and when she shall abandon the possession use and occupancy of said Houses and lots voluntarily or by death said Houses and Lots are to be the property of my five youngest children to wit William W. Flewellen, James T. Flewellen, Abner H. Flewellen, Martha Ann Flewellen, and Julia Frances Flewellen, said Houses and lots to be disposed of after the abandonment thereof by my said wife, by my Executors as they may think fit and proper for the use and benefit of my said five children aforesaid, I further give and bequeath unto my said wife my negro men Sam, Tom, Edmund, Hampton, and my negro boy Henry, and my Negro women Amy, Becca, Letty, Lucy, and Mariah and her child Randolph and my negro girl Harriet together with the future increase of said female slaves to her and her heirs forever. I further give and bequeath unto my said wife all of my house hold and kitchen furniture in Jones county with the exception of such furniture as is hereinafter willed and bequeathed to my children. And I further give and bequeath to my wife all of my stock of every description at my plantation in Jones county with the exception of two mules that are to be transferred from that to my Munroe plantation for the purpose hereinafter named and with the exception of the stock hereinafter willed and bequeathed to my daughter Eliza T. Flewellen, and I further will and bequeath to my said wife all my plantation tools and utensils of every description at my plantation in Jones county and at and on my Lot in the town of Clinton and I further give to my said wife my carriage and Harness and my carriage Horses and my Gig and my waggon and ox carts at my plantation in Jones county to her and her heirs forever. Third I give and bequeath to my daughter Eliza T. Flewellen my negro woman Sealy, my negro man Edmund son of Sealy and my negro boys Isham and Osborn, my negro woman Rose my negro girls Nancy and Everline and my woman Malinda and my boy Willis son of Malinda together with the increase of the negro women to her and her heirs forever; and I further give and bequeath to my said daughter Eliza T. my negro woman Hannah and her child Ellick to her and her heirs forever; And I further give and bequeath to my said daughter Eliza T. my Forte Piano, two beds, bedsteads and furniture, Three cows & calves my Bereau used by her and one Hundred Dollars in cash to purchase her a horse or not as she may think fit. Fourth - I give and bequeath to my five youngest children William W. Flewellen, James T. Flewellen, Abner H. Flewellen, Martha Ann Flewellen, and Julia Frances Flewellen my lands situate lying and being in the county of Munroe in said State and my two lots of land in the Cherokee purchase and my Houses and Lots in the Town of Clinton Jones County Georgia after my wife shall abandon the occupancy thereof to them and their heirs forever in fee simple. And I further give and bequeath to my said five children William W., James T., Abner H., Martha Ann, & Julia Frances all the rest and residue of my negroes not herein before willed and bequeathed away to them and their heirs forever. And I further give and bequeath unto my said last mentioned five children all of my stock of every discription at my plantation in the county of Munroe together with two mules of average value to be taken from my stock of mules in Jones county, and also all the plantation tools & utensils of every discription at my farm in the county of Munroe including my ox carts, and also to each of them my said children last aforesaid two beds, bedstead and furniture be delivered to each of them as they may severally have need in the discretion of my Executors. My Will and desire is that my farm in the county of Munroe shall be kept up and cultivated after my debts are paid with the hands Stock & implements of my said five children last aforesaid for their use so long as my Executors may deem it proper to do so or if my said Executors shall think it best for the interest of said five children they may sell or otehrwise dispose of said farm and lands in the county of Munroe. And my Executors may also dispose of the Lands in the Cherokee purchase or not as they may think best. And in case of the death of either of my said five children before the age of twenty one years & without issue, its share of property is to be equally divided between all my children including my daughter Eliza T. Fifth - I give and bequeath to my son William W. Flewellen my Gold watch. Sixthly and Lastly I nominate and appoint my brother Abner H. Flewellen and James Thweatt Executors to carry into effect this my last will and testament and I further appoint my brother Abner H. Flewellen and James Thweatt Guardian of the persons and property of my children Eliza T. Flewellen, William W. Flewellen, James T. Flewellen, Abner H. Flewellen, Martha Ann Flewellen, and Julia Frances Flewellen. And I hereby revoke all former wills by me made. Give under my hand & seal this the 20th day of August 1835. William W. Bray who being duly sworn saith that they saw William Flewellen sign, seal publish and declare this writing to be and contain his last will & testament and that at the time thereof he was of sound and disposing mind and memory and that he did it freely without compulsion to the best of our knowledge and we further swear that at the time of executing the same we signed the same as witnesses in the presence of the testator.
