I, Frances Gibson of said County and State do make and declare this my last will and testament in manner and and [sic] form following. First I resign my soul into the hands of Almighty God, hoping and believing in a remission of my sins by the merits and mediation of Jesus Christ, and my body I commit to the earth to be burried in a decent and Christian like manner, and my worldly estate I give and demise as follows. First, I give and bequeath unto my friend Ann Lesley the sum of Fifty dollars. Second, I will and direct that all the rest of my estate both real and personal whatsoever and wheresoever the same may be after the payment of my just debts, funeral expenses and charges for the due administration of my estate be equally divided into five parts or shares, one of said parts or shares I give and bequeath unto my son Wiley J. Gibson absolutely and forever. One other of said parts or shares I give and bequeath unto my daughter Nancy T. Whitfield absolutely and forever, one other of said parts or shares I give and bequeath unto my son Taylor F. Gibson absolutely and forever, and one other of said parts or shares I give and bequeath unto my three grand children John H. Gibson, Wiley H. Gibson and Virginia Josephine Gibson absolutely and forever, and the other of said parts or shares I give and bequeath unto my son Taylor F. Gibson upon the trust and confidence that he will suffer and permit my daughter Elizabeth S. Lowther to have the annual gains of the negroes that may fall and be in this part or share, to and for her support and maintenance and to and for the support and maintenance and education of the children of the said Elizabeth S. Lowther for and during her natural lifetime, the said part or share is not in any way to be subject to the debts or contracts of the husband of the said Elizabeth S. Lowther and from and immediately after the death of the said Elizabeth S. Lowther then in trust that he the said Taylor F. Gibson shall transfer and convey the said part or shares and the natural increase thereof and the gains thereof if any over and above the support and maintenance of the said Elizabeth S. Lowther and the support maintenance and education of her children for the children of the said Elizabeth S. Lowther living at the time of her death absolutely and forever and free from all other and further trusts. It is my will and desire that my negroes Harriett and Simon constitute a portion of the part or share I give and bequeathed unto my grand children John H. Gibson Wiley A. Gibson and Virginia Josephine Gibson. Thirdly and lastly I hereby nominate and appoint my son Taylor F. Gibson Executor to carry into effect this my last will and testament. In testimony whereof I have hereto set my hand and seal, this 23rd day of August 1843. I will and direct that my grandson Abner F. Gibson share equally with my three grand children John H. Gibson, Wiley A. Gibson and Virginia Josephine Gibson, that share of my estate I have given and bequeathed to them, that is to said share, to be equally divided between said John H. Gibson, Wiley A. Gibson, Virginia Josephine Gibson an said Abner F. Gibson. In witness whereof I have hereto set my hand and seal this 18th day of July 1846. Hardeman Asbury Kingman James Ford Georgia, Jones County Court of Ordinary February Term 1855 In person appeared in open Court Robert V. Hardeman and Asbury Kingman and after being duly sworn, saith that they saw Frances Gibson the testatrix sign, seal, declare and publish the attached instrument now presented to the court as her last will and testament freely, voluntarily and of her own accord and without compulsion or undue influence whatever, that at the time of the execution of said will, she was of sound and disposing mind and memory, that deponents together with Sandford Tippit as witnesses signed the same in the presence of the Testatrix and at her special instance and request, and in the presence of each other and we us further swear that we saw Testatrix sign, seal declare and publish her codicil to said will to be taken and considered as a part of her will, she did so freely and voluntarily and of her own accord without compulsion or undue influence whatever, that at the time of executing said codicil she was of sound and disposing mind and memory, that deponents together with James Ford as a witness to said codicil signed as witnesses in her presence and at her special instance and request, and in the presence of each other.
