Written: February 17 1847


I, Jacob Mills, being of sound mind and disposing memory make this my last will 
and testament hereby revocking and annulling all others hertofore made by me.

Item 1st. I desire and direct that ll my just debts be paid without delay by my 
Executors herein after named, as I am unwilling my creditor should be delayed 
of their rights especially as there is no necessity for delay.

Item 2nd  I desire and direct that all my property both real and personal, 
wherever and whatever it may be, be appriased and sold by my executor herein 
after named and the proceeds of the same be euqally divided between my 
children, Seth, Martin, Elvira Simons, John Patrick, MOrgan Malberry, Robert 
Jacob, William Towles, Sophiah Smith, Wilson Lumpkin and Elmina.  I appoint my 
trusty and worth friend, James M. Reynolds, Guardian of the person and property 
of my minor children Wilson Lumpkin, William Towles, and Robert Jacob.

Item 3rd  I constitute and appoint my son, Morgan Malberry, Executor to this my 
last will and testament.  This February 19, 1847.

Signed, sealed, declared and published by Jacob Mills as his last will and 
testament, in the presence of us the subscribers, who subscribed our names 
hereto in the presence of said Testator and each other, this Feb. 19th 1847.

Additional Comments:
Jacob Mills was born about 1795 in North Carolina and died about 1847 in Jones 
Co. Georgia. A marrige record in Rowan Co, North Carolina shows a marriage of 
Jacob Mills and Polley Chesheir on Sep 25, 1813.
