JONES COUNTY, GEORGIA WILL RECORD F, PAGES 217-220 State of Georgia County of Jones. I, R. H. Kingman, Sr., of said State and County, being of sound and disposing mind and memory do make and declare this to be my last will and testament that is to say, after my death, 1st. I direct that all of my just debts be paid. 2nd. From my household goods, silver ware, crockery, and kitchen furniture, I direct that my wife, Mrs. Gene Newton Kingman, select such as she desires, to be her sole and separate property, forever and in fee simple. The balance to be equally divided between my children R. H. Kingman, Jr., Daisy Kingman Malone and Robert Hazlehurst Silas, by my executor hereinafter named. 3rd. One fourth of all of my estate, Item Two above excepted, I give to my said wife, Mrs. Gene Newton Kingman, for and during her natural life time, and after her death to go to and vest in my children as follows, to wit: One third to my son, R. H. Kingman, Jr., forever and in fee simple; one third to my daughter Daisy Kingman Malone, for ever and in fee simple; one third to my daughter, Roberta Hazlehurst Silas, as hereinafter directed in Item Six of this will. My said wife being the sole beneficiary in my life insurance policy of $2000.00 with the New York Life Insurance Company, I direct that said insurance, the property given her in item Two above and the property given her in this Item Three, be in lieu of years support and Dower. 4. To my son, R. H. Kingman, Jr., I give, forever and in fee simple, one fourth of all of my estate, saving and excepting the property disposed of in Item Two of this will. 5th To my daughter, Daisy Kingman Malone, I give, forever and in fee simple, one fourth of all of my estate, saving and excepting the property disposed of in Item Two of this will. 6th Saving and excepting the property disposed of in Item Two of this will, I give to my son, R. H. Kingman, Jr., in trust for my daughter Roberta Hazlehurst Silas, one fourth of all of my estate, for and during the natural life time of my said daughter, Roberta Hazlehurst Silas, and after her death to go to and vest in her child or children, or representatives of child or children her surviving, share and share alike, forever and in fee simple. I hereby direct and empower said R. H. Kingman, Jr. as trustee, to take said one fourth of my estate and to manage the same as his best judgment directs and to pay over to my said daughter for the use of herself and her children the rents, issues and profits derived therefrom, at such times and in such amounts as he may deem best. I give unto said trustee full power to sell and reinvest any or all of said property should he deem it necessary for the best interests of my said daughter and her children. Should the rents and profits from said property be insufficient to maintain and support my said daughter, or insufficient to support, maintain and educate my said daughter's children and support and maintain her, then I give said trustee full power to sell or mortgage any or all of said property and to use the proceeds thereof for the purpose of her support and maintenance and education of her children. Should said trustee deem it necessary to sell any or all of said property for reinvestment or for the support and maintenance of my said daughter or for the support and maintenance of my said daughter and the support and maintenance and education of my said daughter's children, I give said trustee full power to convey the fee in said property so sold and said trustee shall not be required to obtain the order of any court for such sale, or mortgage, and said trustee may sell at either public or private sale. Said trustee shall not be required to make any returns of his actings and doings to any court. After the death of my said daughter, Roberta Hazlehurst Silas, said trustee shall make division of whatever property may be left in his hands as trustee between the child or children or representatives of child or children share and share alike. The representatives of children to take per stirpes and not per capita. As compensation said trustee shall reserve to himself the usual fees now allowed by law to guardians. Should said trustee die before the execution of this trust and before my said daughter, Roberta Hazlehurst Silas, then I direct that the judge of the Superior Court of Jones County, Georgia, shall appoint a trustee in the place of R. H. Kingman, Jr., and with all the powers herein given said R. H. Kingman, Jr. as trustee, but in no event shall the present husband of my said daughter, Robert Hazelhurst Silas, ever be appointed as trustee. 7th. For the purpose of carrying this will into effect I hereby nominate and appoint my son, R. H. Kingman, Jr., as sole executor. I direct him to probate this will as required by law, to pay all my just debts, and to make division of all of my estate as provided in this will, and to deliver the property as directed herein, to my wife in Items Two and Three of this will; to my daughter in Item four of this will; to my son in Item Five of this will; and to the trustee in Item Six of this will. In making division of my said estate, my executor shall not be required to obtain the order of any court, but he shall alone make the division and such division shall be binding and conclusive. My said executor shall not be required to make any inventory or appraisement of my said estate, nor shall he be required to make any returns to any court of his actings and doings in the premises. As compensation for his services as executor he shall pay to himself from my estate the sum of $__________[sic].
