I NOAH MESSER knowing that it is appointed for man once to die but being in perfect mind and memory have thought fit to make this my last will and testament. I will that all my just debts be paid. I then will I give unto my beloved wife, BILL and SIMON, CHARLOTTE and SILA to have and to hold until SARA ANN should marry then CHARLOTTE is to be given to my daughter SARA ANN and her children during her natural life and at my wife's death BILL, SIMON and SILA to belong to my daughter SARA ANN at her mother's decease. I give unto my wife all the land on the East side of the Creek where on the houses is and that laying down the Creek and Fifty acres of the __icknor square to have and to hold during her natural life and at her decease the land to be equally divided between my three Sons and I give unto my wife four horses, BILL, the mule, PIGEON and BLASE, five cows and CALVIN, the cart and Oxen and as many of the plantation tools as will do and the cotton gin to have and to hold during her natural life and at her decease it is to be sold and equally divided amongst my Daughters children and the balance of the stock plantation utencils after my wife gets hers is to be sold and divided between my daughters children. ..I will I give unto my Son JOSEPH MESSER three negroes PRINCE, REENY and MUNUAL and at my decease PETER, HILPER with their future increase to him and his heirs forever. ..I will I give unto my Son JOHN B. MESSER four negroes ABRAM, TONEY, GREEN and MILLER and at my decrease ADAM also to him and his heirs forever. ..I will I give unto my Son BENJAMIN MESSER three negroes DENCE, JONAH and STEPHEN and TILL and her future increase at my decease to him and his heirs forever. ..I will I lend unto my Daughter POLLY one negro girl DOLL on the following conditions that said negro be never subject to be sold nor hired out to pay THOMAS PLUMMERS debts but so soon as she shall be taken by an attachment my Executors take said negro and hire her out for the use of her children or otherwide remain in her possession during her natural life and at her death for her and her future increase to be equally divided among her children to them and their heirs and assigns forever. ..I will I lend unto my daughter REBECCA STARNES one negro girl FERIBY during her natural life on the following conditions I will that said negro be not subject to pay her husbands debts and so soon as said negro be attached or sold she be taken by my Exectors and hire her out for the use of her children or otherwise remain in her possession during her natural life. And at her Death for her and her future increase to be equally divided between her children to them and their heirs and assigns forever. ..I will I lend unto my daughter PRISCILLA CLARKE one negro girl ELENDER on the following conditions. I will that said negro is not subject to pay her husbands debts but so soon as she be taken by an attachment she be taken by my Executors as prescribed for the use of her children and at her Death to be equally divided between her children with her future increase to them their heirs and assigns forever. ..I will I lend unto my daughter MARTHA two negroes ROSE and GRACE with their future increase. I will that said negroes be not subject to pay any debts of another person but so soon as they be taken by an attachment my Executors take said negroes and hire them out for the use of her children if any otherwise remain in her possession during her natural life for the use of herself if she has not an heir and at her Death for them and their future increase to be equally divided between her children if any, if not between the surviving Daughters children to them and their heirs and assigns forever. ..I will I lend unto my daughter TABITHA two negroes SILVA and EDA on the following conditions I will that said negroes be not subject to pay the debts of any other person. But so soon as they be attached my Executors take them and hire them out for the use of herself if she has not an heir otherwise remain in her possession during her natural life and at her Death for them and their future increase to be equally divided between her heirs if any if not between the surviving Daughters children. To them their heirs and assigns forever. ..I will I lend unto my daughter SARA ANN one negro CHARLOTTE and her future increase on the above conditions. She is to have her when she marries and at her mothers Death to have SIMON, BILL and SILA with their future increase during her natural life and at her Death for them and increase to be equally divided between her children if any if none between the surviving Daughters children to them their heirs and assigns forever. ..I will that the balance of my Lands be equally divided between my three sons (To Wit) JOSEPH, JOHN and BENJAMIN MESSER to them their heirs and assigns forever and at my wifes decrease for her dower of land to be equally divided between my Sons as above and that if one or more of them died without lawful heir that what I have willed to them be equally divided between the survifving Son or Sons. ..I will that if one or more of my daughters die without a lawful heir that her or parts be equally divided between the surviving Daughter or Daughters...Children to them their heirs and assigns forever. ..I will I give unto my Son JOSEPH one Desk one waggon and the blacksmiths tools. ..I will I give my Son JOHN one sorrel mare. ..I will I give my Son BENJAMIN one young horse and one colt. ..I will I give unto my Grandson JOSHUA C. PLUMER one square of land laying in Lee County in the fourteenth district to him his heirs and assigns forever. ..I will that three hundred dollas of my money be taken to buy a negro for my Daughter PRISCILLA CLARKE to have on the conditions before prescribed to her and her heirs and assigns forever. ..I will I give unto my Grandson NOAH M. CLARKE one hundred dollars to come out of my crop if any if not out of my money after paying my just debts to him and his heirs if any if he dies without an heir it is to be given to his Brother JOHN to him his heirs and assigns forever and I do herby constitute my Son JOSEPH MESSER and my friend ROBERT WOODALL my lawful Executors to this my last will and testament revoking all others here to fore made whereof I have hereunto set my hand and affixed my hand and Seal the 17 th day of November in the year of our LORD Eighteen hundred and thirty two. In presence of: ALFRED WYCHE, JAMES BARNES, JOSEPH MILLER NOAH (his mark X) MESSER Jones County, State of Georgia Court of Ordinary December adjorned term 1832. Then came in to open Court JAMES BARNES and JOSEPH MILLER who being duly sworn say that they were present and saw NOAH MESSER execute the above and foregoing to be his last will and testament on his making his mark and acknowledged the seal and requested deponents to witness the execution thereof and they attested the same as witnesses in his presence and in the presence of each other and they saw ALFRED WYCHE also witness the same at the same time and in the same manner and that said NOAH MESSER was of sound mind at the time of the execution thereof.
