The Last Will and Testament of Willie Patterson State of Georgia, Jones County I, Willie Patterson, of said State and County, being of sound mind and disposing memory and knowing that it is appointed for all men once to die, do make, publish and declare this my last will and testament in manner and form following. To wit, I commit and commend my soul to Almighty God who gave it, and I resign my body to the dust to be buried in a decent Christian like manner. And I make the following disposition of my property to wit. First. I will and direct that all my just debts be paid by my Executors. And for the purpose of paying my just debts, I direct and request that all my property be kept together for the purpose of making one crop after my death, the net proceeds of which, after a support of my family, to be applied to the payment of my debts.The balance of my debts, if any, (is) to be paid out of my property not herein specifically willed and bequeathed away. Second. I give and bequeath unto my beloved wife, Anny Patterson, my two squares of land situate, lying and being in the ninth district of originally Baldwin now Jones County, known by the numbers of forty three and forty four, containing each two hundred two and one half acres more or less. I also give and bequeath unto my said wife Anny Patterson my negroes named Peter, Nelly, George, Henry, Albert, Peggy, and Catherine and the future increase of the said female slaves. I also give and bequeath unto my wife, Anny Patterson, all of my household and kitchen furniture of every description whatsoever, except one bed, bedstead and furniture herein after willed and bequeathed. I also give and bequeath unto my wife, Anny Patterson, all of my horses, cows, hogs, sheep and other stock, with the exception of a horse herein after bequeathed and willed away. I also give and bequeath unto my wife, Anny Patterson, all my plantation tools of every inscription whatsoever including my gin and thrasher and my wagon and cart. I also give and bequeath unto my wife, Anny Patterson, my barouch to have and to hold said land, negroes, and other property unto her, the said Anny Patterson, for and during her natural lifetime or widowhood. And upon the death or marriage of my wife, said land, negroes, and property are to be divided among my children as herein directed. Third. I will and bequeath unto my wife, Anny Patterson, a sufficient quantity of provisions for a support of herself, her lands and stock for twelve months, after which, she may take or receive the property of her legacies under this my last will and testament. Fourth. I will and bequeath unto my daughter, Mary W. Patterson, for her sole and separate use, one bed, bedstead and furniture of her own choice and one horse of the value of seventy five dollars and my negro girl named Anny. Fifth. I will and bequeath unto my son, Hearndon Patterson, my negro man named Jim, heretofore loaned to him. Sixth. I will and bequeath unto my son, Joseph B. Patterson, my negro man named Green, heretofore loaned to him. Seventh. I will and bequeath unto my daughter, Malinda Turner, and her two children, Willie F. Godard and James T. Godard, my negro woman named Arsena, heretofore loaned to my said daughter Malinda. Eighth. I will and bequeath unto my daughter, Penelope Moore, my negro woman named Nancy and her two children and her future increase, for her sole and separate use and support independent of and without the control of her husband for and during her natural life. And, immediately after the death of the said Penelope Moore, said negroes and their increase to go and be equally divided between the children of the said Penelope Moore, share and share alike. The said negroes, their increase, earnings or gains are in no way or manner to be subject to the debts or contracts of the husband of the said Penelope Moore. Ninth. I will and bequeath unto my daughter, Frances T. Godard, my negro woman named Charity and her child and her future increase for the sole and separate use and support of the said Frances T. Godard for and during her natural life independent of and without the control of the husband of the said Frances T. Godard. The said negroes, their future increase, and their earnings and gains are in no way to be subject to the debts or contracts of the husband of the said Frances T. Godard. Said negroes and their future increase are to be equally divided between the children of the said Frances T. Godard, share and share alike. Tenth. I will, bequeath and direct that all the rest and residue of my lands, negroes, property and effects, not herein before bequeathed and willed away, be equally divided into six shares or lots by Peyton L. Pitts, Stephen Clower, David E. Blount, Smilie Seabrooks, James Godard, and John Pitts, or a majority of them. One of said shares or lots I give and bequeath unto my son, Hearndon Patterson. One other of said shares or lots I give and bequeath unto my son, Joseph B. Patterson. One other of said shares or lots I give and bequeath unto my daughter, Malinda Turner and her two children, Willie F. Godard and James T. Godard. One other of said shares or lots I give and bequeath unto my daughter, Mary W. Patterson, for her sole and separate use for and during her natural life and at her death to my eight heirs. One other of said shares or lots I give and bequeath unto my daughter, Penelope Moore, for her sole and separate use and support for and during her natural life, independent of and without the control or intermedling of the husband of the said Penelope Moore. The said share or lot, the gains nor increase thereof, are in no way or manner to be subject to the debts or contracts of the husband of the said Penelope Moore. And, from and immediately after the death of said Penelope Moore, the said share or lot of property and the natural increase thereof is to be equally divided between the children of the said Penelope Moore, share and share alike. And, the other of said shares or lots I give and bequeath unto my daughter, Frances T. Godard, for her sole and separate use and support for and during her natural life, independent of and without the control or intermedling of the husband of the said Frances T. Godard. The said share or lot of property, the gains and increase thereof are not in any way or manner to be subject to the debts or contracts of the husband of the said Frances T. Godard. And, from and immediately after the death of said Frances T. Godard, said share or lot of property and the natural increase thereof are to be equally divided between the children of the said Frances T. Godard, share and share alike. Eleventh. At the death or marriage of my wife, Anny Patterson, the whole of the lands, negroes, and property herein before given and bequeathed to her, together with the natural increase thereof, I will and direct shall be equally divided into six shares or lots. One of said shares or lots I give and bequeath unto my son, Hearndon Patterson. One other of said shares or lots I give and bequeath unto my son, Joseph Patterson. One other of said shares or lots I give and bequeath unto my daughter, Malinda Turner and her two children, Willie F. Godard and James T. Godard. One other of said shares or lots I give and bequeath unto my daughter, Mary W. Patterson, for her sole and separate use and support for and during her natural life and after her death, then to my eight heirs. One other of said shares or lots I give and bequeath unto my daughter, Penelope Moore, for her sole and separate use and support for and during her natural life, independent of and without the control of the husband of the said Penelope Moore. And, from and immediately after the death of the said Penelope Moore, said share or lot of property and the natural increase thereof is to be equally divided between the children of said Penelope Moore, share and share alike. And the other of said shares or lots I give and bequeath unto my daughter, Frances T. Godard, for her sole and separate use and support for and during her natural life, independent of and without the control of the husband of the said Frances T. Godard. The said share or lot of property, the gain or increase thereof, are not in any way or manner to be subject to the debts or contracts of the husband of the said Frances T. Godard. And, from and immediately after the death of the said Frances T. Godard, said share or lot of property and the natural increase thereof are to be equally divided between the children of the said Frances T. Godard, share and share alike. Lastly, I hereby nominate and appoint my friends James Godard and Robert V. Hardeman, Executors to carry this my last will and testament into effect. In testimony whereof I have hereunto set my hand and seal this 7th day of June 1845. In the presence of us and we in the presence of the testator and of each other, one line erased on first page before executors. James Gray Elbert Hutchings Charles Hutchings Codicil Georgia, Jones County I, Willie Patterson of said State and County, do make this codicil to the above and foregoing last will and testament to be taken as a part thereof. I give and bequeath to my beloved wife, Anny Patterson, my negro girl Harriet for and during her natural lifetime or widowhood, and at her death or marriage, said negro to go to my other legatees as directed for my other property in said last will and testament. And I further, in lieu of No. 44 in the ninth District of originally Baldwin now Jones County, give and bequeath unto my said wife, Anny Patterson, the two hundred acres of land where on I now live, lately purchased by me of Samuel T. Cook, to be subject to the stipulations and limitations as before mentioned in my said last will and testament. And, said No.44 in said District is to be divided as directed for the general residue of my said Estate. Second. Whereas my grandchild, James T. Godard, has departed this life since I made my said last will and testament, I will that the property willed to my daughter, Malinda Turner and her two children, Willie F. Godard and James T. Godard, shall be divided between my daughter, Malinda Turner and her son, Willie F. Godard. And, that the share that may fall to my daughter Malinda Turner be hers only for and during her natural lifetime, and at her death, the share that may fall to her may be divided between her son, Willie F. Godard, and her husband, Radford J. Turner. In testimony whereof I have hereunto set my hand and seal, this 13th day of January 1849. Charles Hutchings Elbert Hutchings William Moreland Court of Ordinary, December Term 1852 Georgia, Jones County In open court personally came Charles Hutchings who being duly sworn deposeth and saith that he saw Willie Patterson (said deceased) sign, seal, publish and declare the above and foregoing Last Will and Testament and the codicil thereto annexed as and for his Last Will and Testament that the said Willie Patterson was at the time of executing said Last Will and Testament as well as at the time of executing said codicil of sound and disposing mind and memory. And, that deponent subscribed said Last Will and Testament as well as said codicil as a witness at his request and in his presence. And, that James Gray and Elbert Hutchings signed said Last Will and Testament as witnesses in the presence of said testator and at his request. And that Elbert Hutchings and William Moreland subscribed said codicil as witnesses in the presence of said testator and at his request.
