I Nancy Slatter being of sound mind, and of disposing memory, and knowing that it is appointed, once for all men to die, do make and ordain this to be my last will and testament, in the words, following, to wit: Item 1st: I will and bequeath my soul to God, who gave it, and my body to a christian-like burial. Item 2nd: It is my will and desire that my two old negroes Ben and Sally, his wife, have the choice, at my death to live with whichever of my children they prefer; and it is further my will that my executors give them out of my estate, Fifty Dollars jointly. Item 3. It is my will and desire that my executor give, out of my estate, Fifty Dollars Fifty Dollars [sic] to my two negroes Luke and Chaney, jointly. Item 4th. I give and bequeath to Martha Bostwick, Fifty Dollars. Item 5th. It is my will and desire that all of my property, after paying the above named sums of money, be equally divided among my five children, Elizabeth Lowther, Nancy T. Parrish, Hope H. Slatter, Shadrack F. Slatter, John J. Slatter; and it is further my will that at the death of my daughter Elizabeth Lowther, Nancy F. Howard and the heirs of her body have all of the share that Elizabeth Lowther may draw from my estate. It is also my will and desire at the death of my daughter, Nancy T. Parrish, that her share of my estate go to Frances Ann Slatter, daughter of John J. Slatter - it is, also, my will and desire, at the death of my son, Hope H. Slatter, that Nancy P. Slatter, his daughter, have the share that he (Hope H. Slatter) may draw from my estate. It is further my will and desire, that, before the distribution of my property, my funeral expenses, and the further expense of building a rock wall around my graveyard be paid. It is further my will and desire that whichever of my children my two negroes, Ben and Sally, should prefer to live with, take them at their appraisement in distribution of my property. Item 6th. I do hereby nominate and appoint John J. Slatter to be my executor to this my last will and testament - in testimony where of I here unto set my hand and seal, this 9th November 1838. Test. H. F. Comer, two of the Justices of the Inferior court of said county, in person came H. F. Williams, one of the subscribing witnesses to the within instrument of writing, and being duly sworn, deposeth & saith that he saw Nancy Slatter the testatrix, sign, publish & declare this instrument to be and contain her last will and testament, that she done so freely and without compulsion, and that she was of sound & disposing mind and memory at the execution thereof and that she was of and Joseph Winship subscribe the same as witnesses in the presents of the testatrix and at her request and in the presence of each other. Slatter, the only executor named in the last will & testament of my deceased mother, Mrs. Nancy Slatter, late of Jones county, deceased, do hereby resign and relinquish said executorship, and assign as a reason therefor that I am not a citizen of the state of Georgia and the statute of this state requires citizens to act in that capacity, and that the distance between this and my residence would render it very inconvenient for me to attend.
