I Jenkins D. Weathers of Said State and county, being weak of body but of perfectly sound and disposing mind and memory calling to my recollection that it is appointed for all men once to die, do make constitute and appoint this to be my last will and Testament, Viz. Item 1st. It is my will and desire that all my Just debts shall be paid off by my Executors herein after named as speedily as it can be done, out of debts due to me individually and those in which I have an interest as a partner and from the sale of Goods in which I am either individually interested or as a partner. I desire however that Appleton Justice be permitted by my Executors to select a sufficient amt of notes to inable him to meet the payment of a note made by me to him and Indorsed by him for my accomadation payable in October next at the Bank in Augusta for the sum of fifteen hundred dollars and account to my Exrs. for the surplus of said notes if any after paying of the said fifteen hundred dollar note. Item 2nd. It is also my will and desire that the firm of Justice, Williams & Co. in Clinton in which I am interested one half shall be continued and conducted by the surviving partners for the mutual benefits of themselves and my estate until the first day of January next with power and authority to purchase goods for and on account of said firm to an amt. not exceeding two thousand dollars for the purpose of keeping up an apartment till that time and at that time it is my desire that the goods belonging to said firm shall be divided according to the articles of agreement entered into by the said firm at its commencement and that my shares thereof together with all other goods wears and merchandize which may then belong to my estate to be sold at the discretion of my Exrs. Item 3rd. It is my will and desire further that the firm of Myrick Miller & Co. in Forsyth in which I am now the owner of five shares out of six (having Just purchased out the interest of Evans Myrick in the capital Stock be continued and conducted by the Surviving partners until the first day of January next for the mutual benefit of themselves and my estate with power and authority to purchase goods to an amt. not exceeding one thousand dollars for the purpose of keeping up the apartment, and at that time the goods on hand to be divided between Matthew F. Miller & my Excrs. one share out of Six to him and the balance to my estate. Item 4th. I give and bequeath unto my wife Matilda T. Weathers five thousand dollars to be paid in such of my real or personal estate (other than ready money and evidences of debt) as she may think proper to select at the price or value fixed thereon by the appraisers who may be appointed by the court of ordinary to appraise my estate to her and her heirs forever. Item 5th. I give and bequeath to my Sister Amy Ellison the sum of five hundred dollars in cash to be paid by my Excrs. after the payment of all my debts to her and her heirs forever, but should she not then be in life then to her children share and share alike to them and their heirs forever. Item 6th. I give and bequeath to my brother Isham Weathers the sum of three hundred dollars in cash to be paid by my Excrs. when all my debts shall have been paid to him and his heirs forever. Item 7th. I give and bequeath to my nephew Jenkins D. Weathers son of my brother John Weathers the sum of two hundred dollars to be paid in cash by my Excrs. when all my debts shall have been paid to him and his heirs forever. Item 8th. I give and bequeath to my Wifes Sister Louisiana Pope my negro woman Sue to her and her heirs forever. Item 9th. I give and bequeath to my brother in law Cadesman Pope rent free for the year eighteen hundred and twenty nine my two plantations or tracts of land the one purchased of Mrs. Slatter and the other of Thomas Thweat provided he may think proper to cultivate them. Item 10th. I give and bequeath to Jenkins D. Pope, son of Cadesman Pope, my negro girl Sophy to him and his heirs forever. Item 11th. I give and bequeath to my wife Matilda T. Weathers for and during her natural life my gold patent lever watch chain & key and after her death then to my nephew Jenkins D. Williams if he be then in life and if dead then to go into my residuary bequest here in after mentioned. Item 12th. It is my will and desire that my said wife have the use of my house & lot wherein I now live rent free and be furnished by my Excrs. with provisions untill my debts are all paid or untill she shall receive her specified legacy mentioned in Item 4th and it is also my will and desire that C___ [Cullen?] Pope remain where he now lives on my land for the balance of this year and be supported himself and family out of the Stock of provisions furnished by me for the support of the negroes and Stock on Said plantation I haveing purchased the whole of the property both real & personal formerly owned by him and that my Excrs. furnish him with provisions for himself and family for the year eighteen hundred and twenty nine. Item 13th. It is my will & desire that my Excrs. Sell at the end of this or the commencement of the next year all my perishable property not disposed of above on a credit of twelve months except my waggon & team which they can sell at discretion, my wife never the less to select and keep such articles of furniture as may be necessary & useful for keeping house until she receive her specific legacy mentioned in Item 4th. Item 14th. I give and bequeath to my wife Matilda T. Weathers all the residue of my estate both real and personal which may remain after the payments of all my debts & specific legacies above named for and during her natural life and at her death to be divided equally amongst my brothers & sisters now alive and in case either of them shall die before my wife, then the share of such to be equally divided amongst his or her children then in life except my sister the wife of James Barrow whose children then in life came in with my other brothers & sisters now in life or their children for one equal share. Item 15th. And lastly I do hereby constitute nominate and appoint Appleton Justice & Samuel Lowther to be my lawful Executors to this my last will & Testament.
