I Dennis Bradley of the County of Jones and State of Georgia being in feeble health but of sound mind and memory have called to mind that it is alloted to all flesh once to die to make Constitute and ordain this my last will and testament. In the first place I recommend my Spirit to God the Creator of the Universe who gave it. My body to be decently buried at the discretion of my Executrix. Now touching my worldly matters its my desire that all my just debts should be paid by my Executrix herein after named. Secondly, I give and bequeath to my beloved wife Mary all my estate both real and personal during her natural life or her widowhood. But if she Should marry She Shall be intitled to a childs part only of my estate and a division shall take place as soon as practicable between her and my five children (to wit) Elizabeth, Susanna, John, Mary and Joseph giving to each an equal share. But should she remain single she shall be entitled to the use and management of my estate until her death and no division take place of any part of my property without her consent and not then without that division is equal among all the children. Should my wife remain unmarried it is my desire at her death that the whole of my estate shall be equally divided among my children My estate consist chiefly of the following property (to wit) my undivided part of the lands belonging to the Estate of my late father-in-law Drury Hodges deed who has lately died and a division of his lands has not yet taken place. They consist in the plantation in Jones County where he died Containing Five hundred eighty seven and a half acres more or less and a lot some where in Cherokee I believe contains one hundred and Sixty acres my part of these lands being (1/3) one third. A written agreement has been entered into between the widow Susanna Hodges, Jesse Chambless and myself for the purpose of dividing that estate among ourselves. We being the only heirs to his Estate. Should my disolution take place before that division is completed I do authorize and require my Executrix to complete it according to the terms of that agreement. Also three negroes, Tony a man about twenty two years of age and Sary a girl eighteen and her increase and Dick a boy about fourteen years of age all my stock of every description, household and kitchen furniture, the plantation tools of every description and all other property which may belong to me. My Executrix is authorized to dispose of all crops or rents which may come to her hands from time to time and to sell anything else belonging to my estate, land and negroes excepted, should it so happen that the situation of my wife and children may at any time require the sale of either lands or negroes my Executrix must apply to the Court of Ordinary and show to the Court neccessity of such sale and obtain for the sale of such property before she shall be able legally to dispose of the same. I constitute and appoint my beloved wife Mary Executrix to this my last will and testament. Nov. 28, 1843. And now in Vacation before us Charles Hutchings and James Gray two of the Justices of the Inferior Court in person came Bailey Bell, Samuel Gray, Green G. Gunn, Jesse J. Maddox and Jas G. Martin Subscribing Witnesses to the within instrument of writing and being duly sworn deposeth and Saith that they said Dennis Bradley the testator signed published and declare the within instrument to be and contain his last will and testament and that testator was of sound and disposing mind and memory at the time of executing the same and that deponents subscribed the same as witnesses at his request in his presence and in the presence of each other.
