The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net/ *********************************************************************** Georgia } To the Honorable G.C.Edwards Lee County} Ordinary of said County E.J.Simmons, a citizen of the United States residing in said State and County respectfully shows First, That A.H.Simmons, late of said State and county, died inlistate on the 19th day of July 1902 leaving an estate personal of the probable value of (500) five hundred dollars. 2nd, Petitioner further shows that on account of the length of time required by law to advertise for permanent administration and the circumstances of the estate of said deceased it is necessary that temporary letters of administration upon said estate should be granted at once for the purpose of collecting and taking care of the property until permanent letters are granted. 3rd, Petitioner is entitled under the law to be appointed administrator, being the son of deceased and Mrs L.B.Simmons widow of deceased, declining to act and acquiescing to said appointment. Therefore he prays to be appointed temporary administrator. E.J.Simmons Petitioner Georgia } The application of E.J.Simmons to be appointed temporary Lee County} administrator of the Estate of A.H.Simmons, late of said County, deceased read and duly considered. Ordered, that the applicant be and he is hereby appointed temporary administrator upon said Estate as prayed. Let temporary letters issue to him, upon his taking the usual oath and giving hand in double the amount of all the personal property of said Estate, viz. out saw mill and engine & boiler & fixture thereto, and a lot of lumber at the said mill on the Green place in said County. Given under my hand and official signature this 4th day of August 1902. Geo.C.Edwards Ordinary Lee County of Ordinary Aug Term 1902 ordered that T.J.Green, G.W.Barrow, W.D.Green, J.T.Ferguson and A.A.Paul be and they are hereby appointed appraisers of the estate of A.H.Simmons, late of Lee County, dec'd. and that the usual warrant issue in terms of the law. This Aug 4, 1902 Geo.C.Edwards Ordinary Georgia } To Hon G.C.Edwards Lee County} Ordinary of said County Your petitioner having been this day appointed Temporary Administrator of the Estate of A.H.Simmons late of said County, dec'd. now respectfully petitions the Court to be appointed permanent administrator and for citation in the usual Terms of the law be ordered to run in the Lee County Journal for the appointment of the petitioner as permanent administrator on said Estate. Geo.C.Edwards Ordinary Warrant of Appraisement, with Oath State of Georgia, Lee County By the Court of Ordinary of Said County To T.J.Green, G.W.Barrow, W.D.Green, J.T.Ferguson, & A.A.Paul These are to authorize you, or any three of you, whose names are hereabove written, to attend and appraise the goods and chattels, lands, tenements, rights or credits, of A.H.Simmons, deceased. Wheresoever any of the goods, chattels, lands, tenements, rights, or credits of said deceased are within the County of Lee and which shall be shown unto you by E.J.Simmons his Administrator or come to your knowledge or sight, you having first taken an oath before some legally authorized person to make a true and perfect appraisement and inventory thereof, and to cause the same to be returned under your hands, or any three or more of you, to the said Court within two months from the date hereof. Sworn to & subscribed before me H.L.Long before me this Dec 7th 1903 Geo.C.Edwards Ordinary Lee Court Ordinary Aug Term 1902 Filed Aug 4, 1902 J.W.Morgan Dept Clk SC Recorded on Minutes B pages 312 & 313 Georgia } To the Hon G.C.Edwards Lee County} Ordinary of said County Your petitioner respectfully shows that 1st, he has been appointed temporary administrator on the Estate of A.H.Simmons late of said County deceased. 2nd, That so far as he knows the Estate of said deceased consists of personal property only, towit a saw mill - engine, boiler & the usual fixtures thereto and some lumber, and logs now cut for sawing into lumber. 3rd, That the said lumber is liable to waist & destruction by being exposed to fire & the weather and that said logs are likewise liable to loss as well as the mill and fixtures. 4th, Wherefore your petitioner asks an order to advertise the aforesaid property for sale at public outcry after ten days notice in the Lee County Journal with the privilege and right allowed you petitioner to sell the said property at private sale sooner if he in his judgment can make a more advantageous sale of the saw. Respt submitted This Aug 4th 1902 E.J.Simmons In Lee Court of Ordinary Sept Term 1902 Order Granting Permanent Letters of Administration Georgia } In the Court of Ordinary for said County Sept Term 1902 Lee County} E.J.Simmons having made application in due form to be appointed permanent administrator upon the estate of A.H.Simmons late of said County deceased and a citation giving notice of said application to all concerned having been issued and published as required by law, and in appearing that said application should be granted, no objection being offered, ordered that the said E.J.Simmons be and he is hereby appointed permanent administrator upon said Estate. Let permanent letters of administration issue to him accordingly, upon his taking the usual oath of office & giving bond in the sum of one thousand dollars. This Sept 1st 1902 Geo.C.Edwards Ordinary In Lee Court of Ordinary Sept Term 1902 Filed in Office Sept 1st 1902 J.W.Morgan Dept Clk Ordinary Recorded Georgia } To the Hon. the Court of Ordinary Lee County} of said County Your petitioner respectfully shows that he is a minor and was 14 years of age 27th day of October 1901 - That his father A.H.Simmons and mother Mrs Annie E.Simmons are both dead and that he has no guardian. That he has a small interest in property personal and therefore requests your Honor to appoint his brother E.J.Simmons as my said guardian.
