Sealed with our seals, and dated at Leesburg the sixteenth day of February in the year of our Lord, One Thousand Eight Hundred and ninety three. The Condition of the above Obligation is such, That if the above bound A.H.Simmons Administrator of the goods, chattels and credits of Annie E Simmons deceased, do make a true and perfect inventory of all and singular the goods, chattels and credits of the said deceased, which have or shall come to the hands, possession, or knowledge of the said A.H.Simmons or in the hands or possession of any other person or persons for him and the same so made do exhibit in the Court of Ordinary of said County when he shall be thereunto required, and such goods, chattels and credits do well and truly administer, according to law, and make a just and true account of his actings and doings therein, when required by the Superior Court or the Ordinary for the said County, and all the rest of the goods, chattels and credits which shall be found remaining upon the account of the said administration, the same being first allowed by the said Court, shall deliver and pay to such persons respectively as are entitled to the same by law. And if it shall hereafter appear, that any last Will and Testament was made by the said deceased, and the same be proved before the Court, and the Executors obtain a certificate of the probate thereof, and the said A.H.Simmons do in such case, if required, render and deliver up the said Letters of Administration, then this obligation to be void, else to remain in full force. Georgia } To the Hon G.C.Edwards Lee County} Ordinary of said County E.J.Simmons a citizen of said County and state respectfully shows that Annie E.Simmons late of said County died intestate on the 16th day November 1892 leaving an estate consisting of realty & personalty. Petitioner further shows that his father A.H.Simmons late of said County now deceased administered ofson said Estate which was finally disposed of by a deone in equity based upon a Bill to Marshall the assets of said Estate which said Bill and Decree were had in Sumter Superior Court said State. That there has recently come a small amount of property to the heirs of said A.E.Simmons of the probable amount of Three Hundred Dollars from a Life Insurance policy which said amount of money is held up awaiting proper administration on said Estate. Petitioner further shows that said Admin of money should be collected and distributed among the heirs of said Estate. Wherefore he prays to be appointed as such administrator De bonis non and to that end that citation giving notice of this application to all concerned be issued and published as required by law. E.J.Simmons Petitioner Georgia } The application of E.J.Simmons to be appointed Lee County} administrator de-bonis-non of the Estate of Annie E.Simmons, late of said County, deceased read and duly considered. Ordered that Citation issue & be published in the Lee County Journal as required by law. this Sept Term 1902 Court of Ordinary of said County Geo.C.Edwards Ordinary Citation in written application having issued upon published & required by law. Upon agreement by Counsel in the case. E.J.Simmons thereto consenty it is indeed thus E.B.Lee he and he is hereby appointed Administrator De Bonis non on estate of Annie E Simmons decd as the said E.B.Lee is hereby authorized to wind up all the unfinished affairs of said estate and take charge of same in the filing of a bond with good and solvent surety in the sum of Three Hundred Dollars for his faithful discharge of Duty & taking the oath of office. This Oct 14th 1902 Geo.C.Edwards Ordinary Objection of E.B.Lee Filed in office Sept 27, 1902 J.W.Morgan Dept Clk Ordy Recorded C.H.Beazley Atty In Re Ex Parte Application of E.J.Simmons for letters of Administration on Estate of Annie E.Simmons Decd. In Court of Ordinary Lee County October Term 1902 And now comes E.B.Lee Son of Annie E.Simmons and objects to the Appointment of petitioner as administrator on the said estate for the following reasons to wit 1st because the law provided that the next of kin shall be entitled to administer on the estate of a decendent and the said E.J.Simmons is not the next of kin to said deceased. 2nd Because the law provided that the preference being given to the next of kin will give the same to your petitioner whos is the next of kin to wit the son of the said Annie E.Simmons whereas the said E.J.Simmons is in no way related to the said Annie E.Simmons and not entitled in any manner to be the Administrator on the said estate having no interest in the same and being a stranger to the said estate. 3rd Because the said E.J.Simmons is not a fit and proper person for said administration for the above and other reasons. 4th For the above reasons the said E.B.Lee objects to said appointment and asks that he the only child of mature age of decd and her next of kin be appointed as administrator on the said estate. Sworn to before me this Sept 27 1902 J.W.Morgan Dept E.B.Lee Clerk Ordinary Caveat sustained Oct 14, 1902, and E.B.Lee appointed Administrator de bonis non Oct 14, 1902 Geo.C.Edwards Ordinary Court of Ordinary Lee County Georgia October adjourned Term 1902 - Oct 14 - 1902 E.B.Lee having this day been appointed administrator de bonis non on the estate of Annie E.Simmons late of said County & having duly qualified - It is ordered that R.A.Forrester, E.B.Martin, J.R.Long, S.J.Powell and C.F.Putnam be & they are hereby appointed appraisers upon said estate to appraise such of said estate as have not herebefore been appraised & that the usual warrant issue.
