Indenture made the twenty fifth day of April in the thirty second year of the Reign of our Sovereign Lord George the second by the grace of God of Great Britain France and Ireland King Defender of the faith & so forth and in the year of our Lord one thousand seven hundred and fifty nine Between Benjamin Andrew & Susannah Andrew of the Parish of St Johns and Province of Georgia of the one part and John Golden of the same parish and province aforesaid planter of the other part Witnesseth that the said Benjamin Andrew for and in Consideration of the Sum of two Hundred and fifty pounds lawfull money of the province aforesaid to him in hand well and truly paid by the said John Golden at or before the sealing and delivering of these presents for the absolute purchase of all and singular the lands tenements and Hereditaments herein after particularly mentioned the receipt of which said sum of two Hundred and fifty pounds lawfull money of this province as aforesaid the said Benjamin Andrew doth hereby acknowledge and confess and thereof and from every part and parcel thereof doth for ever acquit release and discharge the said John golden his heirs Executors administrators and Assigns by these presents He the said Benjamin Andrew hath granted bargained sold released conveyed and confirmed and by these presents the said Benjamin Andrew doth grant bargain sell release convey and confirm unto the said John Golden in his own actual possession now being by virtue of a bargain and sale for one whole year to him thereof made by the said Benjamin Andrew for and in Consideration of the sum of five shillings by Indenture bearing date the day next before the day of the date of these presents to commence the day next before the day of the date hereof and by force of the statute made for transferring uses into possession and to his heirs and Assigns for ever all that plantation tract and parcel of four hundred acres of land more or less situate lying and being in the parish & province aforesaid and on a branch of Newport butting & bounding to the north on lands of Hannah Godfrey to the south on lands of James Andrew, to the East on lands of John Stewart Junr and to the west on lands of Richard Baker now in possession of the said Benjamin Andrew & hath such shape form & marked trees as are expressly laid down in a platt of the same Reference being thereunto had may more fully and at large appear and which said tract of four Hundred acres of land being part & remainder of a grand platt of five Hundred acres of land granted to the said Benjamin Andrew as will appear by the said grant hereto annexed given under the hand of his Excellency John Reynolds late Governour of the province aforesd bearing date the 31st Octr 1755 together with all the houses, out house Edifices Buildings barns stables yards gardens orchards ways paths privileges waters watercourses profits Commoditys appurtenances & Hereditaments whatsoever to the same belonging or in anywise appertaining now in the tenure & Occupation of him the said Benjamin Andrew and the reversion & reversions, remainder & remainders of all yearly and other rents issues and profits thereof and of every part & parcel thereof with their and every of their appurtenances And also all the Estate right title Interest properly profit claim & demand whatsoever either in law or equity of him the said Benjamin Andrew of in & to the same ____ or any part or parcel thereof together with all deeds Evidences & writings touching or concerning the said premises or any part or parcel thereof which he the said Benjamin Andrew hath in his custody or power or can come by without suit in law or equity To Have and to hold the said plantation or tract or parcel of four Hundred acres of land and premises herein before mentioned and intended to be hereby granted bargained and sold and every part and parcel thereof with their & every of their appurtenances unto the said John Golden his heirs and assigns to & for the only use & benefit & behoof of the said John Golden his Heirs & Assigns absolutely forever and the said Benjamin Andrew for himself his Heirs Executors & administrators doth covenant possess grant and agree to and with the said John Golden his heirs and assigns by these presents in manner and form following /Viz/ that he the said Benjamin Andrew now at the time of the sealing & delivery of these presents hath good right, full power and lawfull and absolute authority to grant release & confirm the said plantation tract or parcel of four Hundred acres of land, together with the Hereditaments and all & singular & other the premises herein before mentioned & intended to be hereby granted and released & every part & parcel thereof with these and every of their appurtenances without any power of revocation limitation of any uses or other restraint (?) matter or thing whatsoever to alter change charge defect or evict the same unto the said John golden his Heirs and assigns unto there only use benefit & behoof absolutely for evermore And also that it shall and may be lawfull to and for the said John golden his Heirs and assigns from time to time & at all times hereafter peaceable & quietly to enter into have hold use occupy possess and enjoy the said plantation tract or parcel of four Hundred acres of land aforesaid, together with the Hereditaments hereunto belonging & all & singular the property herein before mentioned, or intended to be hereby granted & released and every part and parcel thereof with their and every of their appurtenances without _____ full let trouble molestation or Interruption of him the said Benjamin Andrew his Heirs and assigns or any other person or persons lawfully claiming or to claim from by or under him or them or any of them and that free & clear & freely & clearly & absolutely acquitted exonerated & discharged by the said Benjamin Andrew his heirs and assigns of from and against all and all manner of former & other gifts grants bargains sales wills Entails Jointures dowrys thirds annuities Taxes Assessments charges and Encombrances whatsoever had made done committed or suffered by him the said Benjamin Andrew or any other person or persons whatsoever lawfully claiming or to claim from by or under him or them And further that the said Benjamin Andrew his Heirs & all & every other person or persons lawfully claiming or to claim any ___ right title Trust or Interest unto the said plantation tract or parcel of four Hundred acres of land to from or under him or them shall and will from time to time and at all times hereafter at the reasonable request proper cost & charge in the law of the said John Golden his heirs and assigns make do acknowledge & execute or cause & procure to be made done acknowledged & executed all & every such other & further lawfull & reasonable act & acts thing and things conveyances & assurances in the law whatsoever for the ___ & more perfect and absolute conveying & assuring of the said plantation tract or parcel of four hundred acres of land, together with the Hereditaments thereunto belonging & all & singular & other the premises herein before mentioned & intended to be hereby granted & released and every part & parcel thereof with their & every of their assurances to & for the only use Benefitt & behoof of the said John golden his Heirs and Assigns for ever according to the will intent & meaning of these presents as by the said John Golden his Heirs & assigns or his or there Counsel learned in the law shall be reasonable advised devised or required And lastly that the said Benjamin Andrew for himself his heirs Executors & administrators the said plantation and parcel of four Hundred acres of land together with the Hereditaments & premises above mentioned with their and every of their Appurtenances unto the said John Golden his Heirs & assigns against him the said Benjamin Andrew his heirs and every other such person or persons whatsoever lawfully claiming or to claim from by or under him or them shall & will warrant & for ever defend by these presents IN WITNESS whereof the said parties abovementioned viz Benjamin Andrew and Susannah his wife in token of her free consent in this act and deed of her Husbands and ___ presents to testify her renunciation of dower and of any future pretend of Claim or right of thirds of the said tract of land now sold/ To these present Indentures have sett their Hands & seals the day and year first above written Signed sealed & delivered in presence of Bn Andrew John Osgood John Edwards Susanah Andrew Stephen Clark Received the day & year first within mentioned of the within named John Gordon the full and just sum of two Hundred and fifty pounds sterling money & lawfull money of this province of Georgia and being in full of the Consideration money within mentioned Received by me Bn Andrew Witness John Osgood John Edwards Stephen Clark St. Johns Parish in Georgia Be it remembered that on the first day of June 1759 Stephen Clark one of the within subscribing witnesses personally appeared before me the subscribers one of his Majestys Justices for the parish and province aforesaid who being duly sworn deposeth that he was present & did see Benjamin Andrew & Susannah Andrew his wife sign seal & deliver the within Instrument as their act and deed.
