Georgia To all Christian people to whom these presents shall come William Baker of the parish of St. Johns Midway and of the aforesaid province planter sendeth greeting Know ye that the said William Baker for and in Consideration of the sum of One Hundred and twenty eight pounds eleven shillings and five pence sterling to him the said William Baker in hand and before the ensealing and delivery of these presents well and truly paid by Samuel Jones of the parish of St Marks in So Carolina on black river planter the receipt whereof the said William Baker doth hereby acquit Exonerate and discharge the said Samuel Jones his Heirs Executors & administrators and by these presents hath given granted bargained sold aliened enfeoffed and confirmed and by these presents fully freely clearly and absolutely give grant bargain sell alien enfeoff and confirm to the said Samuel Jones his heirs executors administrators and Assigns for ever a certain parcel or tract of land containing four Hundred acres more or Less lying and being on a branch commonly called the third branch of Newport in the parish of St Johns and province aforesaid formerly granted to one Elizabeth Baker and the said Elizabeth Baker dying the property became vested in the aforesaid William Baker the said tract of land of four Hundred acres doth but and bound to the North on lands of John Humphrey to the south on lands of Mr John and Joseph Winn to the east on lands of Mr Richard Baker and to the west on lands of Mr Joseph Bacon which will more fully appear reference being had to a plan hereunto given or hereunto annexed certified with the hand of Mr Benjamin Baker Depty Surveyor To have and to hold the said tract of land of four hundred acres together with the Ways privileges Easements Immunities Hereditaments and Commodities with the liberty of Hunting hawking fishing and fowling within the limits of the same and at the trees waters and every other thing there on being growing belonging or by any means appertaining excepting the quit rent here after to become due for the same to his Majesty to him the said Samuel Jones His Heirs and assigns for ever to him and there own proper uses Benefits and behoof for evermore And the said William Baker for himself his Heirs Executors & administrators doth covenant and promise to and with the said Samuel Jones & his Heirs in manner and form following that is to say, that at the time of this present bargain & sale and until the ensealing and delivery of these presents, he the said William Baker is the true and sole owner of the above granted premises and hath in himself good & rightful power and lawfull authority to grant sell & convey and assure the premises in manner and form as aforesaid and that the said Samuel Jones his Heirs and Assigns shall and may from henceforth and for ever hereafter by force and virtue of these presents lawfully peaceably and quietly have hold use occupy possess and enjoy the above granted primisses & their appurtenances and every part and parcel thereof without any let molestation Trouble denial Expulsion Eviction hindrance or contradiction for him the said William Baker his Heirs Executors or administrators or any other person or persons whatsoever claiming or having any lawfull Claim right title or Interest therein from by or under him or by any other lawfull ways or means whatsoever and also that the said William Baker his Heirs Executors or administrators shall and will upon every reasonable request and at the cost and charge in the law of the said Samuel Jones his heirs Executors administrators or Assigns further do & execute or cause to be done and executed all and every other lawfull and reasonable act or acts deed and deeds, Conveyances and Assurances in the law whatsoever for the more perfect surveying, confirming and assuring the premises with the Appurtenances unto the said Samuel Jones his Heirs and Assigns as by the said Samuel Jones his Heirs or assigns or his or their Counsel learned in the law shall be reasonably advised devised or required In witness whereof the said William Baker and Sarah his wife in token of her Consent in this act & deed of her husbands have hereunto set their hands and seals the Eighth day of November in the thirtysecond year of his Majestys reign and in the year of our Lord 1758 Signed sealed and delivered William Baker in presence of Sarah Baker B Andrew R Baker James Andrew I the subscriber one of the witnesses to the present deed, did likewise see the said William Baker delivery make of the abovementioned tract of land by turf and twig the day and year abovementioned R Baker Receivd the day and year within mentioned of the within named Samuel Jones the sum of one Hundred and twenty eight pounds eleven shillings and four pence sterling money being in full of the Consideration money within mentioned William Baker Witness B Andrew R Baker Georgia Memorandum that on the twenty third day of December in the year of our lord one thousand seven hundred and fifty eight before me John Stevens Esq one of his Majestys Justices assigned to keep the peace in the district of Midway River personally appeared & came Richard Baker & made oath that he did see Willm Baker & Sarah hi Wife sign seal & as their voluntary act & deed deliver the within deed to & for the uses within mentioned on the eighth day of November 1758 & that he did at the same time see James Andrew & Benjn Andrew subscribe their names as Evidences together with himself Sworn the day and year above written before me John Stevens 1758 Recorded
