People unto whom these presents shall come Richard Baker Planter of the Parish of St. Johns and Province aforesaid sendeth greeting Know ye that the said Richard Baker for and in Consideration of the sum of fifty pounds sterling to him in hand well and truly paid by John Winn Esq or the same parish and Province aforesaid at or before the sealing and delivery of these presents the receipt whereof the said Richard Baker doth hereby acknowledge and Possess and thereof and of and from every part & parcel thereof doth hereby acquit exonerate and discharge the said John Winn his Heirs Executors and administrators hath granted bargained sold aliened enfeoffed and confirmed and that freely fully clearly and absolutely doth grant bargain sell alien enfeoff & confirm unto the said John Winn all that tract or parcel of two hundred acres of Land situate and being in Saint Andrew’s Parish on a branch of Newport River and is butting & bounding to the Northward on Land of the said Richard Baker to the Westward on Land laid out unto Henry Petty all other sided on vacant Land which said tract of two hundred acres as aforesaid by his Present Majesty was lately granted to the said Richard Baker and hath such shape form and marks as is expressly laid Down in a plan unto said Grant annexed ussrance being thereunto had more fully and at large appears to have & to hold the said tract or parcel of two hundred acres of Land together with all and singular the houses outhouses Barns Stables Yards Gardens Orchards meadows pastures feedings Commons Woods Coppices Liberties Easements paths privileges Waters Water Courses profits Commodities Emoluments rights members and appurtenances whatsoever to the same belonging or in any wise appertaining or accepted taken or known and enjoyed held occupied Leased or demised as part parcel or member of the same the Interest hereafter thereon becoming due to his Majesty only excepted unto the said John Winn his Executors and Administrators in trust to and for the only use benefit and behoof of Rebekah Petty Wife of Henry Petty of Newport and Saint John’s Parish and her Heirs and assigns for evermore to her & their own proper use forever and the said Richard Baker for himself his heirs Executors and administrators doth Covenant and promise to and with the said John Winn his Executors and Administrators in manner & form following that is to say that at the time of this present bargain and sale and untill the sealing and Delivery hereof he the said Richard Baker is the true and sole Owner of the above granted premises & hath in himself good and rightfull power Lawfull and absolute authority to Grant Sell Convey and assure the premises in the manner & for the use aforesaid and that the said John Winn his Executors and Administrators in trust to and for the said Rebekah petty and her Heirs as aforesaid shall & may henceforth and for ever hereafter by force and virtue of these presents lawfully peaceably quietly have hold use occupy possess and enjoy the above granted premises with their appurtenances and every part or parcel thereof without any let molestation trouble Denial Expulsion Eviction hinderances Contradition from him the said Richard Baker his Heirs Executors or Administrators or any other Person or Persons whatsoever claiming or having any lawfull claim right title or Interest therein from by or under him or by any other lawfull ways or means whatsoever and also that the said Richard Baker his Heirs Executors and Administrators shall and will upon every reasonable request and at the Cost & charges in the law of the said John Winn his Executors administrators further do and Execute or cause to be done and executed all and every other lawful and reasonable act or acts Deed or Deeds Conveyances and assurances in the law whatsoever for the more perfect Conveying Confirming and assuring that premises with their appurtenances unto the said John Winn in trust or the said Rebekah Petty for her and her heirs as aforesaid or his or their Council learned in the law shall be reasonably advised Devised or required and lastly that the said Richard Baker for himself his heirs Executors and administrators the said tract of two hundred acres of Land together with the appurtanances Above mentioned unto the said John Winn his Executors and administrators in trust to and for the above said against the said Richard Baker his Heirs and every such other person or persons whatsoever lawfully claiming or to claim from by or under him or them shall and will warrant and for ever defend by these presents In Witness whereof the said Richard Baker & Elizabeth his Wife in token of her free Consent to this act & deed of her Husband thereby renouncing her Dower or right of third in or to the premises have here unto set their hand & seals the seventeenth day of December in the ninth year of his Majestys Reign and year of our Lord one thousand seven hundred & sixty eight Signed Sealed and Delivered Richard Baker In presence of Elizabeth Baker James Andrew Wm Graves Thos Stevens Received the day and year within written of the within named John Winn the sum of fifty pounds sterling being the Consideration within mentioned per me Richd Baker Witness Thos Stevens Memorandum The Day and year within written the within named Richd Baker Took quiet possession Livery and ____ of the of the same did yield and deliver the said within named John Winn for the use of Rebakah Petty and her Heirs forever and to the purport true intent & meaning of the within deed of bargain & sale Witness Thos Stevens Richd Baker Georgia St. John’s Parish } Personally appeared before Me Parmenas Way one of his Majesty’s Justices Assigned to keep the peace in said parish Thomas Stevens and made Oath that the said Richard Baker and Elizabeth Baker Sign seal and deliver the within deed and that he Likewise saw James Andrew & William Graves Sign together with himself as Evidence to the same Sworn before Me
