All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beth Collins http://www.genrecords.net/emailregistry/vols/00011.html#0002523 October 27, 2009, 2:04 pm Written: May 29, 1759 Recorded: June 4, 1759 Colonial Deeds Book C1, pp. 407-408 Georgia To all Christian people to whom these presents shall come John Graves of the parish of St. Johns and province aforesaid planter sendeth greeting Know ye, that the said John Graves for and in Consideration of the sum of five shillings sterling before the sealing and delivery of these presents to him in hand well and truly paid by James Andrew of the same parish & province aforesaid planter for the absolute power of a parcel or lott of land hereafter particulary mentioned the receipt whereof the said John Graves doth hereby confess & acknowledge and himself therewith fully satisfied & contented & doth by these presents from every part & parcel thereof for ever acquit release and discharge the said James Andrew his Heirs & assigns, and by these presents hath granted bargained sold conveyed and confirmed to the abovesaid James Andrew his Heirs & assigns for ever. All that parcel or lott of land containing fifty feet in front or width & seventy feet in leangth in the aforesaid parish being part of the tract of land commonly called Graves End on the third branch of North Newport River on the south side of the said river or branch near the public Landing & situate to the eastward on the said landing path bounding to the Northward & westward on the lands of the sd Graves and known by the number four & hath such shape & form as is expressly laid down in a plan of the same certified by Andrew Way Dept Surveyer reference being thereunto had with more fully & largely appear To have and to hold the said parcel of lot of land containing fifty feet front and seventy feet in length above mentioned granted & sold, together with all and singular thereon & every part & parcel thereof & every of the appurtenances unto the sd Andrew his Heirs and assigns to and for their only use benefits and behoof forevermore the said John Graves at the delivery of these presents doth promise warrant & agree with the said James Andrew that he hath full power & absolute authority to grant sell & confirm the said lott or parcel of land aforesaid without any power or revocation unto the said James Andrew his Heirs and Assigns unto there own benefit & behoof absolutely for evermore. And further that the said John Graves his Heirs and every person or persons lawfully claiming or to claim any Estate title trust or Interest unto the said lot or parcel of land abovementioned by from or under him or them shall & will from time to time and at all times hereafter at the reasonable request proper use & charges in the law of the said James Andrew his Heirs & Assigns make do acknowledge & Execute all & every such other & further lawfull & reasonable Conveyances & Assurances in the law whatsoever for the more perfect & absolute conveying & assuring of the said parcel or lot of land containing fifty feet in width & seventy feet in length abovesaid as by the said James Andrew his Heirs & assigns or his or there Councel learned in the law shall be reasonably advised & required. And lastly that the said John Graves for himself his Heirs Executors & administrators the said parcel or lott of land containing fifty feet in width & seventy feet in depth together with all the appurtenances thereto belonging unto the said James Andrew his Heirs & assigns against him the said John Graves his Heirs & every such other person or persons whatsoever lawfully claiming or to claim from by or under him or them shall and will forever warrant & defend by these presents In witness whereof the said John Graves and Elizabeth Graves his wife in token of her free consent in this act of her husbands testifying hereby her renunciation of dower and any future presence of Claim or right of thirds in or to the aforesaid parcel or lot of land, have hereunto set their hands & seals the twenty ninth day of May in the year of our Lord One thousand seven Hundred and fifty nine & in the thirtysecond year of his Majestys reign signed sealed & delivered John Graves in presence of Elizabeth Graves James Fisher Thomas Christie William Swinton Receivd the day & year within written of the within named James Andrew the full sum of five shillings sterling in full of the consideration money within mentioned receivd to me John Graves Witness William Sinton St Johns parish in Georgia } These are to certify that on the second day of June 1759 Thomas Christie personally appeared before me the subscriber one of his Majestys Justices for the parish & in the province aforesaid who being duly sworn declared that he was present and did see John Graves & Elizabeth his Wife sign seal & deliver the within Instrument as their act & deed & that he also saw James Fisher & William Swinton sign thereto as witnesses together with himself.
