All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beth Collins http://www.genrecords.net/emailregistry/vols/00011.html#0002523 July 11, 2010, 2:24 pm Written: June 6, 1758 Recorded: June 13, 1758 Colonial Deed Book C1, pp. 283-284 Georgia To all people to whom these presents shall come William Graves of Midway in the province aforesaid planter sendeth greeting, Know ye that the said William Graves for and in consideration of the sum of Ten pounds sterling to him the sd William Graves in hand at and before the ensealing and delivery of these presents well and truly paid by Benjamin Andrew of Midway aforesaid planter the receipt whereof the sd William Graves doth hereby acknowledge and thereof and of every part and parcel thereof doth acquit Exonerate and discharge the sd Benjamin Andrew his heirs Executors and Administrators by these presents hath given granted bargained and aliened enfeoffed and confirmed and by these presents doth fully freely clearly and absolutely give grant bargain sell alien enfeoff and confirm to the sd. Benjamin Andrew his heirs Executors Administrators and Assigns for ever, a certain parcel or Tract of land containing two hundred acres or thereabouts be the same more or less situate in the district of Midway aforesaid butting and bounding on the south on lands belonging to the sd Benjamin Andrew and on the north vacant land and on the East on lands belonging to the sd Benjamin Andrew and West on John Humphreys land as may be seen with the form and shape of the same by a plan thereof thereto, annexed, reference thereto being had together with the ways privileges Easements Immunities hereditaments and commodities thereunto belonging or by any means appertaining. To have and to hold the above granted premises and privilege of hunting hawking fishing and fowling within the bounds Limits of the same and all the buildings houses woods, trees waters fences and other things thereon standing growing or being or thereunto by any Means belonging or appertaining / except the quit rents hereafter to become due and payable of the same / to him the sd Benjamin Andrew his heirs and assigns for ever to his and their own proper use benefit and behoof for ever more and the said William Graves for himself his heirs Executors and administrators doth Covenant and promise to and with the said Benjamin Andrew his heirs and Assigns in manner and form following that is to say that at the time of this present bargain and sale and until the ensealing and delivery of these presents he the sd. William Graves is the true sole and lawfull owner of all the above granted premises and hath in himself good right full power lawfull authority to grant sell convey and assure the premises in manner and form as aforesaid and that the said Benjamin Andrew his heirs and assigns shall and may from henceforth and for ever hereafter by force and virtue of these presents lawfully peaceably and quietly have hold use occupy possess and enjoy the above granted premises and their appurtenances and every part and parcel thereof without any lett Molestation trouble denial Expulsion Eviction or contradiction from him the sd. William Graves his heirs Executors or administrators or any other person or persons whatsoever claiming or having any lawfull claim right title or Interest therein from by or under him or by any other lawfull way or Means whatsoever and also that the said William Graves his heirs Executors or administrators shall and will upon every reasonable request and at the cost and charge in the Law of the sd Benjamin Andrew his heirs Executors Administrators or Assigns further do and Execute or cause to be done and executed all and every such further and other lawfull and reasonable act and acts deed and deeds conveyances and assurances in the Law whatsoever for the more perfect conveying confirming and assuring the premises with their appurtenances unto the sd Benjamin Andrew his heirs and assigns as by the sd Benjamin Andrew his heirs or assigns or his or their Councill learned in the law shall be reasonably advised devised or required In Witness whereof the said William Graves and Rebecha his wife in token of her consent to this act and deed of her husband have hereunto set their hands and seals this sixth day of June in the thirtieth second year of the reign of our sovereign Lord George the second by the grace of God King &c and in the year of our Lord one thousand seven hundred and fifty eight Signed sealed and delivered in presents of William Graves Richd Baker Rebecca Graves James Harvey Richd Girareau Who did see the abovementioned William Graves delivery make of the above mentioned Tract of land by Turf and twig the day above written Ricd Girardeau Rec’d the day and year within written from the within named William Graves the sum of ten pounds sterling current Money of the sd province being in full of the consideration money within mentioned Witness William Graves Richd Baker Richd Girardeau Georgia Memorandum That on the seventh day of June in the year of our Lord One thousand seven hundred & fifty eight Before me John Stevens Esqr one of his Majestys Justices appointed to keep the peace in the district of Midway Rivers personally came & appeared Richard Girardeau & made oath that He did see the within named William Graves & Rebecca Graves within named sign seal & as their voluntary act & deed deliver the within Instrument of writing for the uses therein mentioned &he also saw Richd Baker & James Harvey subscribe their names as Evidences together with himself sixth day of June 1758 Sworn the day & year above written before me John Stevens J.
