All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beth Collins http://www.genrecords.net/emailregistry/vols/00011.html#0002523 October 27, 2009, 1:59 pm Written: January 6, 1769 Recorded: January 10, 1770 Colonial Deeds Book V, pp. 22 – 25 This Indenture made the sixth day of January in the Year of our Lord one thousand Seven Hundred and Sixty Nine and in the Ninth Year of the Reign of our Sovereign Lord George the third by the grace of God of Great Britain France and Ireland King defender of the faith and so forth Between Samuel Jones Planter of the parish of St John and province aforesaid and Rebekah his wife of the one part and James Andrew Planter of Newport in the Same parish and province of the other part Witnesseth that for and in consideration of the sum of one hundred pounds Sterling to the said Samuel Jones in Hand at and before the sealing and Delivery of these presents by the said James Andrew well and truly Paid the Receipt whereof the said Samuel Jones Doth hereby acknowledge and thereof and of every part and Parcel thereof doth Acquit, Release exonerate and Discharge the Said James Andrew his heirs Executors and Administrators and every of them forever by these presents the said Samuel Jones Hath granted Bargained Sold Alliened Released and Confirmed and by these presents doth fully Clearly and absolutely grant Bargain Sell Allien Release and Confirm unto the said James Andrew in his Actual possession now being by Virtue of a Bargain and Sale to him thereof made by the Said Samuel Jones for one whole year for the for the Consideration of five Shillings by an Indenture of Lease bearing date the day next before the day of the date of these presents to Commence from the day next before the Day of the date hereof and Sealed and Delivered before the Executing of these Presents and also by force of the Statute for transfering of uses into Posession in that Case made and provided and unto his heirs and assigns forever all that Tract or parcel of four hundred acres of Land Situate Lying and being in Saint Andrews parish in the aforesaid province on a Branch of north Newport River and is Buting and Boundin to the north on Lands on Laid out unto Lydia Sanders to the South on lands of the said James Andrew and to the East and West on Vacant Land and Hath Such Shape form and marks as is Expressly Laid Down in a Plan of the same Annexed to his Majestys grant of the Said Land unto the said Samuel Jones Witness James Wright Exqr. Govenour and Commander in Chief of the aforesaid Province Bearing date the first day of November one thousand Seven hundred and Sixty Eight Relation being thereunto had more fully and Larger appears together with all and Singular the Gardens orchards fences ways wells waters watercourses easements profits Commodities advantages Instruments hereditaments and Appurtainances Whatsoever to said tract or parcel of four hundred acres of Land belonging or in any wise appertaining and the Reversion and Reversions Remainder and Remainders Rent Rents Issues and profits there of and of every part and parcel thereof and also all the Estate Right Title Interest Posession properly profit Claim and Demand Whatsoever Either in Law or Equity which they said Samuel Jones and his wife Rebekah now have or ever had or which they or their heirs hereafter shall Can or ought to have of in to or out of the said tract of four hundred acres of Land and other the premises with their and every of their appurtenances Together with all Deeds plats grants Charters Writings and Moniments Whatsoever which he the said Samuel Jones now has in his Custody or possession or can come by with such in Law or equity that do only Convey the premises To have and to hold the said tract or parcel of four hundred acres of Land and all and singular other the premises hereby granted and Released or meant and Interest to be granted and Released unto the said James Andrew his heirs and assigns to the only uses and Behoof of the said James Andrew his heirs and assigns forever and the Said Samuel Jones for himself his heirs Executors and Administrators doth Covenant promise Grant and agree to and with the said James Andrew his heirs and assigns by these presents in Manner and form following that is to say that the said Samuel Jones now at the time of the Sealing and Delivery of these presents is and Standeth Lawfully and Absolutely Seized of and in the said tract of four hundred acres of Land and all and singular other the premises herein before mentioned and Intended to be hereby Granted and Released and every part and parcel thereof with their and every of their Appurtenances of a good sure perfect and Absolute Estate of Inhertances in fee simple without any manner of Condition Trust Proviso power of Revocation or Limetation of any use or uses or other Restraint matter or thing whatsoever to alter change Charges Defeat or evict the Same and also that the said Samuel Jones now hath in himself Good Rightfull power and lawfull and Absolute authority to Grant Releas and Confirm the Said tract of four hundred acres of Land and all and Singular other the premises herein before mentioned and Intended to be hereby Granted and Released and every part and parcel thereof with their and every of their appurtenances unto the said James Andrew his heirs and assigns forever as aforesaid And Also that is shall and may be Lawfull to end for the said James Andrew his heirs and assigns from time to time and at all times hereafter peaceably and Quietly to enter into have hold occupy posess and Enjoy the Said tract of four hundred acres of Land and singular other the Premises herein before mentioned and intended to be hereby granted and Released and every part and parcel thereof with their and every of their appurtenances without the Lawfull Lett Suit Trouble Molestation _____ or Interuption of the said Samuel Jones his heirs Executors or Administrators or any other person or persons Whatsoever Claiming or to Claim by from or under him and that free and Clear and truly and Clearly and absolutely aquited Exonerated and Discharged of and from all and all manner of former and other and other Gifts Grants Bargains Sales uses Wills Intails Juntures Dowers Judments Executions Charges and Incumbrances Whatsoever had made Done Committed or Suffered by the said Samuel Jones or any other person or persons whatsoever Lawfully Claiming or to Claim by from or under him And Lastly that the Said Samuel Jones and his heirs and all and every other person and persons lawfully Claiming or to Claim any Estate Rights Title trust or Interest of in or to the Said tract of four hundred acres of Land and all and singular and other the premises herein before mentioned and Intended to be hereby Granted an Released or any part of parcel thereof shall and will from and at all times hereafter at the Reasonable Request and proper Cost and Charges in the Law of the said James Andrew his heirs and assigns make do Acknowledge and Execute or Cause and procure to be made Done Acknowledged and Executed all and every Such further and other Lawfull and Reasonable act and acts thing and things Conveyances and assurances in the law whatsoever for the further Better and more perfect and absolute Granting Conveying and assuring the said tract of four hundred acres of Land and all and singular other the premises herein before mentioned and Intended to be hereby Granted and Released and every part and parcel thereof with their and every of their appurtenances to and for the uses and behoof of the said James Andrew his heirs and assigns forever as by him or them or by his or their Council Learned in the Law shall be reasonably Devised or advised and Required In Witness whereof the said parties have Interchangably sett their hands and seals the day and year above Writen Samuel Jones Rebecca Jones Received the Day and Year within written of the within James Andrew the sum of one hundred pound sterling being the full Consideration within mentioned I say Received by me Samuel Jones, Sealed and Delivered in presence of Jonathan Searth William Searth Georgia St. Johns Parish } Memorandum that on the twenty first day of March in the year of our Lord one thousand Seven hundred and Sixty nine Before me Andrew Darling Esq. one of his majesty Justices assigned to Keep the peace in the parish and province aforesaid personally Came and appeared Jonathan Searth and made oath on the holy Evangelist that he did see the within Named Samuel Jones and Rebekah Jones Sign Seal and Deliver as their act and Deed the within Deed to and for the uses within mentioned and Did also see the said Samuel Jones sign the Receipt hereon Indorsed and did Likewise see William Searth Subscribe his name as Witness thereto --- Sworn the Day and Year above written before me – Andw
