To all Christian People to whom these presents shall come John Winn of St. John Parrish Midway and province aforesaid planter / sendeth Greeting / Know ye, that the said John Winn for and in Consideration of the sum of Six pounds sterling to him the said John Winn in hand at and before the ensealing and Delivery of these presents well and truly paid by James Andrew of the same parrish and province planter, the Receipt whereof the said John Winn doth hereby acknowledge and thereof and of every part and parcel thereof Doth acquit Exonerate and Discharge the said James Andrew his Heirs Executors and Administrators and by these presents Hath given granted, Bargained, sold, aliened, Enfeoffed and confirmed and by these presents Doth fully, freely, clearly, and absolutely give, grant, Bargain, Sell, alien, enfeoff and Confirm to the said James Andrew his Heirs, Executors, Administrators and Assigns forever A Certain parcel or Tract of Land containing Nineteen and a half acres or thereabouts be the same more or less, situate on Newport and on a swamp commonly cald the Ash Swamp Butting and Bounding to the West on Lands of the said John Winn and to the North South and East on Lands of the said James Andrew as by a plan hereunto anexed / Reference being thereunto had/will more fully and largely appear Together with the Way, Priviledges, Easments, Immunities, Hereditaments, and Comodities thereunto belonging or by any means appertaining/ To have and to Hold/ the above granted premises and priviledges of Hunting, Hawking, Fishing and Fowling within the bounds and Limets of the same, and all the Buildings, Houses, Trees, Waters, Fences, and other things thereunto Standing, growing & being or thereunto by any Means belonging or appertaining except the Quitrent hereafter to become due to his Majesty for the same, to him the said James Andrew, his Heirs and Assigns forever to his and there own proper use, Benifitt and Behoof forevermore and the said John Winn for himself his Heirs Executors and Administrators Doth Covenant and promise, to and with the sd. James Andrew his Heirs and Assigns in manner and form following / that is to say/ that at the time of this present Bargain and sale, and until the ensealing and delivery of these presents, he the said John Winn is the True sole and Lawfull owner of all the above granted premises and hath in himself good and rightful power and authority to grant, sell, Convey and Assure the premises in manner and form as aforesaid, and that the said James Andrew his Heirs and Assigns shall and may from henceforth and forever hereafter by force and Virtue of these presents Lawfully Peaceable, and quietly, have hold use occupy possess and injoy the above granted premises and there Appurtenances and every part and parcel thereof without any Lett Molestation, Trouble, Deniall, Expulsion, Eviction or Contradition from him the said John Winn his Heirs, Executors or Assigns or any other person or persons Whatsoever claiming or having any Lawfull Claim Right Title or Interest Therein from or by or under him or by any other Lawfull ways or Means Whatsoever, and also that the said John Winn his Heirs Executors or Administrators shall and will upon every Reasonable request and at the Cost and Charge in the Law of the said James Andrew his Heirs executors Administrators or Assigns, further Do and execute or cause to be Done and executed. All and every such further and other Lawfull and Reasonable act and acts Deed and Deeds Conveyances and Assurances in the Law whatsoever for the more perfect conveying, confirming and Assuring the premises with there appurtenances unto the said James Andrew his Heirs and Assigns as by the said James Andrew, his heirs or assigns or his or there Councle learned in the Law shall be Reasonable Advised, Revised or Required In Witness whereof the said John Winn and Ann his Wife in to her of her Consent to his act and Deed of her husband have hereunto sett their hands and seals the Twentieth Day of September in the Thirty Second year of his Majestys Rein and in the year of our Lord One Thousand Seven hundred and fifty eight. Tract of Land by Turf and Twig the 26th September 1758 John Osgood Received the Day and year Within Written from the within Named James Andrew the sum of six pounds sterling Current Money of the said province being in full of the Consideration Money within Mentioned. Witness John Winn John Osgood St. John’s Parish In Georgia } Be it Rember’d that on the 3d November 1758 the Revd. Mr. John Osgood one of the within subscribing Witnesses personally appear’d before me the subscriber and of his Majesty’s Justices for the parish aforesaid, who being Duly sworn Declared That on the Day within mention’d he saw John Winn & Ann Winn sign, seal & Deliver the within Instrument as their act & deed as also Turf & Twig in Lieu of the premises, and that he also saw Joseph Way and Samuel Bacon sign together with himself as Witnesses thereunto.
