All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beth Collins http://www.genrecords.net/emailregistry/vols/00011.html#0002523 January 8, 2011, 8:25 pm Written: June 23, 1768 Recorded: February 2, 1769 Colonial Deed Book S, pp. 378-379 Georgia To all People to whom these presents shall come John Winn Esqr of the Parish of St Johns and Province aforesaid send greeting Know ye that the said John Winn for and in consideration of the Sum of fifty Pounds sterling to him the said John Winn in hand well and truly paid by Richard Baker Planter of the same Parish and Province aforesaid at or before the sealing and delivery of these Presents the receipt whereof he the said John Winn doth hereby acknowledge and confess and thereof and of and from every part or parcel thereof doth acquit Exonerate and discharge the said Richard Baker his Heirs Executors and administrators and by these Presents hath granted bargained sold aliened enfeoffed and confirmed and that freely fully clearly and absolutely doth Grant bargain sell alien enfeoff and confirm unto the said Richard Baker his heirs Executors Administrators and Assigns all that tract or parcel of one hundred acres of Land being part of a five hundred acre tract originally granted to the said John Winn situate on Newport and on a Swamp commonly called the ash swamp and is butting and bounding to the North on land of the said Richard Baker to the South on vacant land and to the East on the remainder of the said tract granted to the said John Winn as aforesaid and to the West on Land late of the Estate of John Stevens deceased and sold to Captain David Anderson of South Carolina in Trust for his Nephew William Anderson and hath Such Shape form and marks as is expressly Laid down in a platt of the same reference being thereunto had more fully and at Large appears to have and to hold the said tract of one hundred acres of Land together with the houses outhouses Barns Stables yards Gardens orchards Meadows pastures feedings Commons woods Coppices Liberties Easments Emoluments rights members and appurtenances whatsoever to the same belonging or in any wise appertaining or accepted reputed taken or known held occupied Leased or demised as part parcel or member of the same the Quit rent thereon hereafter becoming due to his Majesty only accepted unto the said Richard Baker his Heirs and assigns forever to him & their own proper use and behoof forevermore and the said John Winn for himself his Heirs Executors and administrators doth Covenant promise and agree to and with the said Richard Baker in manner following that is to Say that at the time of this present bargain and Sale and until the sealing and delivery of these presents he the said John Winn is the true and lawfull Owner of the above granted premises and hath in himself good and rightfull Power and lawfull and absolute authority to grant sell and Covey the premises in manner aforesaid and that the said Richard Baker his heirs and assigns shall and may from henceforth and forever hereafter by force and virtue of these presents lawfully peaceable and quietly have hold use occupy possess and enjoy the above granted Premises and their appurtenances and every part and parcel thereof without any let molestation trouble denial expulsion Eviction hindrance or contradiction from him the said John Winn, his heirs Executors or Administrator or any other person or persons whatsoever claiming or having any Lawfull claim right title or Interest therein from by or under him or by any other lawful ways or means whatsoever and also that the said John Winn his heirs Executors and Administrators shall and will upon every reasonable request and at the Cost and Charges in the law of the said Richard Baker his heirs Executors administrators or assigns further do and Execute or cause to be done and executed all and every other lawful and Reasonable act or acts deed or deeds conveyances and assurances in the Law whatsoever for the more perfect conveying confirming and assuring the premises with their appurtenances unto the said Richard Baker his heirs and assigns or his or their Council learned in the Law shall be reasonable advised or required and lastly that the said John Winn and his heirs the said tract of one hundred acres of Land as aforesaid with their rights members and appurtenances unto the said Richard Baker his heirs and assigns against every person or persons whatsoever claiming or to claim from by or under him or them shall and will warrant and for ever defend by these presents In witness whereof the said John Winn hath hereunto set his hand and seal the twenty third day of June In the eight year of his Majesty’s reign and year of our Lord 1768 John Winn Sealed and delivered in presence of } Received the day and year within written Jas. Andrew } Henry Petty memorandum: the day and year within written the within named John Winn took possession Livery and seisen of all and singular the within granted Premises and the Like Quiet possession Livery and Seisen of the same did yield and deliver the said within named Richard Baker his heirs and assigns for ever according to the purport true intent and meaning of the within deed of bargain and sale John Winn Witness Jas. Personally appeared before me the Subscriber one of his Majesty’s Justices assignd to keep the peace for the Parish and province aforesaid James Andrew and made oath that he was present and saw John Winn Sign seal and deliver the within Instrument as his act and deed and turf and twig in lieu of the premises and that he also saw Andrew (sic) Petty and Thos.
