Jones, Trustee Marriage Agreement Registered December 30th 1832 Georgia } Columbia County} Whereas a marriage is shortly intended to be had and solemnized between Charles H. Wilson of the County of Lincoln in said state, and Sarah Ann Harrison of the County and State first aforesaid and whereas it hath been agreed by and between the said Charles H. Wilson and Sarah Ann Harrison that her property real and personal to which she is entitled as one of the heirs and daughters of the Estate of her deceased father, Cook Harrison, as well as any other property which she may now or hereafter have an expectancy from any other person or persons by will or otherwise shall be previous to the said intermarriage conveyed to Edward W. Jones of the County and state first aforesaid to and for her sole and separate use and benefit. Now this Indenture made and entered into by and between the said Charles H. Wilson, Sarah Ann Harrison and Edward W. Jones on the 8th day of June in the year of our Lord One Thousand Eight hundred and thirty one. Witnesseth that the said Sarah Ann Harrison by and with the full knowledge and consent of the said Charles H. Wilson her said intended husband for and in consideration of the several trusts and covenants herein after considering and of one dollar to her in hand paid at and before the sealing and delivery of these presents Doth grant bargain sell convey transfer assign and set over unto the said Edward W. Jones his heirs and assigns all and singular her undivided interest in and to the real and personal Estate of her deceased father, Cook Harrison, as well as any other property real or personal which she now has, or at any time hereafter may have in expectancy from any other person or persons by will or otherwise. Together with all and singular the rights, members? and appurtenances thereof to the same being belonging or in anywise appertaining and the remainders, reverses, rents, issues and profits thereof and of every part thereof. To have and to hold the said Estate real and personal as before mentioned unto the said Edward W. Jones his heirs and assigns in trust nevertheless and to and upon the several uses interests and purposes hereinafter mentioned and ordered that is to say to the use and benefit of the said Sarah Ann Harrison and her heirs until the said intended marriage shall be had & solemnized and from and after the solemnization of the said marriage to the sole and separate use of the said Sarah Ann Harrison and for her maintenance benefit and support and for the maintenance benefit support and education of the child or children of the said Sarah Ann and Charles H. Wilson by the said intended marriage for and during the natural life of the said Sarah Ann and after her death then in trust to the sole use benefit & behoof of the said child or children of the said Sarah Ann & Charles H. Wilson by the said marriage and the heirs of such child or children forever to be equally divided between them if there be more than one share and share alike and further that all the rents, issues and profits of the said property hereby conveyed and intended to be conveyed as well as the renting out of the land and hiring out of the negroes, shall at all times be subject to the entire control of said Sarah Ann so that the said Edward W. Jones as trustee aforesaid in no instance be liable for the same or any part thereof Provided nevertheless and it is hereby declared and agreed between all the parties to these presents that it shall and may be lawful to and for the said Sarah Ann Harrison at any time hereafter whether before or after the intended marriage by and with the written consent of the said Charles H. Wilson expressed by his becoming a party to this the deed and witnessed by two or more credible witnesses to cause assent and set aside this instrument of binding? as fully and effectively as if the same had never been made or to grant bargain sell convey or otherwise dispose of the said property real or personal hereby conveyed or intended to be conveyed or any part thereof in any manner whatsoever the proceeds of such sale to be entirely at the control of the said Sarah Ann. And it is further agreed and understood by and between the parties by these presents that the said property hereby conveyed both real and personal and every part thereof shall at all times be subject to any written contract made and entered into jointly by the said Sarah Ann and Charles H. Wilson. In witness whereof the parties to these presents have hereunto set their hand and seals the day and year first above written. Charles H. NOTES: Attached is a transcription of a marriage contract between Charles H. Wilson of Lincoln Co., GA and his intended, Sarah Ann Harrison of Columbia Co., GA dated June 1831 and registered Dec. 1831. It would seem Sarah Ann inherited considerable property from her deceased father and this contract is to protect that. Hope you can use this on the Lincoln County site.
