Court, 1800-1877 Georgia Lincoln County In the name of God Amen, I Mary Glaze of the County and State aforesaid, being of advanced age, feeble in body, but of sound and disposeing mind and memory being desiring to make a disposition of the property with which a kind providence has blessed me do make, ordain, declare and publish this to be my last will and testament. Item 1st -I desire and direct my body be buried in a decent christain like manner, and I trust my soul will return to God who gave (sic -it to me). Item 2nd -I desire and direct that my Executor hereinafter named shall pay my just debts as soon as the nature of the circumstances will permit. Item 3rd- with the conditions limitations and restrictions hereinafter mentioned and imposed, I give to my daughter Julia Ann Albea wife of Tilman Albea for her support and the support and maintainance of her minor children my tract of land whereon I now live in said county containing one hundred and eleven acres, more or less, and also the choice one of my two negros, to wit Isaac and Jinney, my said daughter to make her own selection after my decease without regard to valuation for and during the tenur of her natural life, the said land and negroe nor either of them nor the annual rents, issues, and profits of either shall be subject to the debts, contracts power or control of her present or any future husband, so as to impair in the least this my desire and intention of securing the benefits of said property to my said daughter during her life, and at the death of my said daughter Julia Ann Albea, I give desire and direct the said property both real and personal herein given to her during her life together with all its increase and advantages be equally divided among her children and their ??? representative, share and share alike. Item 4th - I give five hundred dollars in money to be equally divided share and share alike between my Grand children to wit. Ellington Searls, Mary Francy Searls, Martha Searls, Elizabeth Searls, Julia Ann Searls and Thomas Searls children of Thomas Searls, Jr. as their full distributive share in all my estate both real and personal, and should either of my said grandchildren die before there is a distribution of my estate & this legacy paid over by my Executor then and in that case I desire and direct the said five hundred dollars shall be equally divided among the surviving brothers and sisters. tem 5th - All of the balance of my estate, left after the paying my just debts, funeral expenses, and necessary expenses of administration no matter what it may consist nor wherever it may be with the restrictions and limitations mentioned in 3rd Item of this will I give to my daughter Julia Ann Albea and at her death to her children. Item 6 - After my daughter Julia Ann Albea shall make her choice of a negro slave, I desire and direct my Executor to sell my other slave in the way and manner he may think most conducive to the welfare of said slave and the interest of my estate, and appropriate so much of the proceeds of said sale as will be sufficient to pay the money legacy to my grandchildren and my just debts. Item 7th - I hereby constitute and appoint Stephen B. Smith trustee to take charge of and manage and control the property herein given to my daughter Julia Ann Albea for hers and her childrens benefit support and maintainance. Item 8th - I also hereby constitute and appoint Stephen B. Smith the Executor of this my last will and testament to carry the same into effect.
