Peacock, James B. Peacock, Simon M. Peacock, Benjamin Herring & Jinsey Herring his wife and Samuel B. Fairchild & Edney Z. Fairchild his wife of the County & State aforesaid, have made nominated and appointed and by these presents do make nominate & appoint John A. Green of the County of Wayne & State of North Carolina, our true & lawful agent and attorney in fact for us and in our names & for our use & benefits to ask, demand, sue for, recover and receive of and from James Griswold Clerk and Master of the Court of Equity for said County of Wayne the sum of sixty seven & 82/100 dollars being our share of the net proceeds of the sale of certain lands belonging to the estate of Sully Johnston deceased, who inherited the same from his father Jethro Howell dec’d, said land having been sold under a decree of said Court of Equity and the monies therefore received by said James Griswold Clerk & Master as aforesaid, we being entitled thereto as the heirs at law of Wealthy Peacock deceased who was the Aunt and one of the heirs at law of said Sully Johnston deceased; and to have, use & take all lawful ways & means in our names or otherwise for the recovery thereof either by suing out and prosecuting any & all manner of legal process only compounding & arbitrating according to his last discretion; and all proper & necessary acquittances or other sufficient release & discharges for us and in our names to make seal and deliver, and to do all lawful acts & things whatsoever, concerning the premises as fully and effectually in every respect as we ourselves might or could do were we personally present In testimony whereof we the said Benajah Peacock, Howell Peacock, Robert MC Peacock, Delamar C.
