Felton, Sr. Ordinary of said County: The petition of Mrs. Ella Shepherd, and J. E. Davant, both residents of said State, respectfully shows 1. That P.G. Shepherd late of said county, died on the 3rd day of December 1915, after having made and published his last will and testament in which your petitioners are nominated executrix and executor, respectively, thereof, 2. Petitioners herewith present said last will and testament of said deceased, and show that the following named persons are the heirs and all the heirs at law of the said testator to-wit: Mrs. Ella Shepherd, his widow, who is one of our petitioners as above shown, and who resides in Macon county Georgia; and his children viz: Mrs. Louisa T. Shepherd, Mrs. Georgia A.L. Cheney, Mrs. Frances Elizabeth Oliver, and Mrs. Annie Claude Poe, all of Bibb county Georgia; Mrs. Jesse W. Flewellyn of McDuffie county Georgia; Mrs. Minnie Lee Hill of Ware county Georgia; Mrs. Jeffie A. E. Manry, L.J. Shepherd, Charles C. Shepherd, Misses Imogene Shepherd, Ella Bess Shepherd, and Laura Elaine Shepherd, all of Macon county Georgia; that all the said heirs at law are of full age, except the said Laura Elaine Shepherd, who is a minor over the age of fourteen years. 3. Petitioners pray leave to probate said will in solemn form, with the codicil thereto annexed, and to that end, that the said heirs at law above named, of said deceased, be cited to appear at the next court of Ordinary for said county of Macon on the first Monday in January 2916, then and there to show cause, if any they have, why the said will should not be proven with its codicil, in solemn form and admitted to record as the last will and testament of the said P.G. Shepherd deceased, and why letters testamentary should not issue to your petitioners according to the statute in such case made and provided. 4. Petitioners further pray that a guardian ad litem may be appointed by your Honor to represent the said Laura Elaine Shelpherd the said minor heir at law, in this proceeding. And petitioners will ever pray, etc. L. Greer, Petitioners' Attorney. Georgia-Macon County. I, P.G. Shepherd, of said State and county, being of sound and disposing mind and memory, do make this my last will and testament, hereby revoking all other wills heretofore made by me. I desire and direct that all my just debts be paid as soon after my death as practicable. To my daughter Louisa T. Shepherd, I give and bequeath four hundred dollars. To my four daughters, Georgia A. L. Chaney, Frances Elizabeth Oliver, Jeffie A. E. Manry and Minnie Lee Hill, I give and bequeath one thousand dollars apiece; that is, I want each of the said four daughters to have one thousand dollars. To my beloved wife, Ella Shepherd, I give and bequeath the following property during her life or widowhood, and which is to be in lieu of dower and years support to-wit: one hundred and thirty nine acres of land more or less, the same being part of lot of land number thirty four (34) in the thirteenth (13th) District of Macon county Georgia, and on which I now reside. I also give to my wife, Ella Shepherd during her life or widowhood, all the personal property that I may own at the time of my death, including household furniture, stock of all kinds, horses, cows, hogs, also corn fodder and all other produce including cotton, also all money notes and accounts, and all other property both real and personal that I may own at the time of my death except amount disposed of in item two of this my will. After the death or marriage of my said wife, I desire and direct that all the property I have bequeathed to her shall be divided share and share alike among our three daughters to-wit: Emogene, Ella Bess and Laura Elaine Shepherd. To my two sons. L. J. Shepherd and Charles C. Shepherd, and my two daughters, Annie Claude Poe and Jesse W. Flewellen I give nothing for the reason that I have already given them all I intend for them to have. I nominate and appoint my wife, Ella Shepherd executrix and J. E. Davant of Butler Georgia, executor of this my last will and testament; and I authorize and empower the said executors to sell such of my property as they may deem proper without an order from court. In witness whereof I the said P. F. Shepherd to this my last will and testament have hereunto set my hand and seal this 30th day of September 1912. P.G. Shepherd as his last will and testament in the presence of us who at his special instance and request in his presence and in the presence of each other have subscribed our names hereto as witnesses, this 30th day of Sept. 1912. Shepherd of said State and county being of sound and disposing mind and memory do make this codicil to my last will and testament dated 30th September 1912: I make the following changes in regard to the amounts bequeathed to my daughters Louisa T. Shepherd, Georgia A. L. Cheney, Frances Elizabeth Oliver, Jeffie A. E. Manry and Minnie Lee Hill: To my daughter Louisa T. Shepherd I give nothing for the reason that I have already given her all I intend for her to have. To my four daughters Georgia A.L.Cheney, Frances Elizabeth Oliver, Jeffie A.E. Manry and Minnie Lee Hill I give and bequeath five hundred dollars apiece; that is, I want each of my said four daughters to have five hundred dollars only. My reason for making these changes in my will is that I have not as much property now as I had when my said will was made. In witness whereof, I the said P. G. Shepherd, to this codicil to my last will and testament have hereunto set my hand and seal this 16th day of April 1913. P.G. It appearing to the court in the matter of the petition for probate in solemn form of the last will and testament of P.G. Shepherd, deceased, filed by Mrs. Ella Shepherd and J. E. Davant, that Laura Elaine Shepherd, one of the heirs at law is a minor and has no regularly appointed guardian; It is therefore ordered by the court that Charles C. Shepherd be and he is hereby appointed guardian ad litem to represent said minor in this proceeding. This December 6th 1915. A.C.Felton Sr. Ordinary. Georgia--Macon County. Having been appointed guardian ad litem to represent Laura Elaine Shepherd a minor in the matter of the probate in solemn form of the last will and testament of P.G. hepherd deceased in the court of Ordinary of Macon county Georgia, I hereby accept said appointment and I agree to represent the said minor in said proceeding. Davant for the probate in solemn form of the last will and testament of P.G. Shepherd late of said county deceased having been read and considered, It is ordered that Mrs. Louisa T. Shepherd, Mrs. Georgia A.L.Cheney, Mrs. Frances Elizabeth Oliver, Mrs. Annie Claude Poe, Mrs. Jesse W. Flewellyn, Mrs. Minnie Lee Hill, Mrs. Jeffie A. E. Manry, L. J. Shepherd, Charles C. Shepherd, Misses Imogene Shepherd, Ella Bess Shepherd and Laura Elaine Shepherd and Charles C. Shepherd as guardian ad litem of the said Laura Elaine Shepherd, appear before the court of Ordinary of said county of Macon on the first Monday in January 1916, then and there to show cause in any they have why the paper offered for probate by the said Mrs. Ella Shepherd and J. E. Davant, the petitioners named in the foregoing petition should not be proved in solemn form and admitted to record as the last will and testament and codicil of the said P.G. Shepherd deceased. Let a copy of this petition and of this order be served personally, upon the said several heirs at law above named at lest ten days before the next term of this cout. This December 6, 1915. A.C.
