Annual Returns, Book G, Pp.264-6 Written: November 29, 1857 And whereas James Thompson Jr., the principal legatee under said will both to avoid unpleasant litigation as well as a desire to be liberal in his dealings with his brethen is willing to relinquish all claims, interest, and title to so much of the property of said estate, at its appraisal value as shall amount to six thousand dollars. Now thereinfore in consideration of the foregoing promises we are distributors at law of the said James Thompson Sr. viz John L. Bell and Jane Bell, his wife formerly Jane Thompson, Annie Carrington formerly Annie Thompson, James Sterling in right of his wife Elizabeth Sterling, formerly Elizabeth Thompson, Sarah Whitaker formerly Sarah Thompson, William Thompson, James Thompson, Alexander Thompson, and Richard W. East in right of his wife Abagail (these last four constituting the representatives and heirs at law of Alexander Thompson deceased). William Carrington, James Carrington, Micajah Carrington, King Carrington, Hugh Carrington, Emily Carrington, Nancy Carrington, Wilson Langford in right of his wife Demaris formerly Carrington, William C. Porterfield in right of his wife Sarah formerly Sarah Carrington, Russell Carithers in right of his wife Martha, formerly Martha Carrington (these last eleven constituting the representatives and heirs at law of Mary Carrington formerly Thompson deceased have and do hereby freely and fully relinquish and quit claim jointly and severally, collectively, and individually unto the said James Thompson Jr. all of our right, title claim and interest present or prospective in and to any portion of the estate real or personal of the said James Thompson Sr. deceased either as legatees under his will or distributees at law were the will set aside and annulled. And we do hereby bind ourselves, our heirs, and legal representatives to stand to and abide by this agreement and settlement and never process or otherwise to seek to interfere with or disturb this agreement and settlement to be binding upon those signing this although it may not be subscribed by all. In witness whereof we have hereunto set our hands and seals this 29th day of November 1857. Signed sealed and declared in presence of William Hodge and James Thompson Jr. Additional Comments: James Thompson Sr. left a will in Madison Co. Will Book B, p. 56. The will was dated 8 April 1841 and brought before the Court of Ordinary July term 1851. James Thompson Sr. was born on 18 Dec. 1763 in Pennsylvania and died on 29 June 1851 in Madison Co., Ga.
