Franklin (NOT associated with Tracking Your Roots) Madison County, Georgia Deed Book I 14 Dec 1840 274 Georgia } This Indenture made Madison County } this fourteenth day of December in the year of our Lord Eighteen hundred and forty between Irodell Carruth Alford Carruth Josiah Carruth James E Carruth Isaac A Mcuen in right of his wife James C Freeman in right of his wife and Elizabeth Carruth all of the County of Madison & State of Georgia being the heirs and Representatives of Adam Carruth late of the County of Madison & State of Georgia deceased of the one part and John A Pittman of the County and State aforesaid of the other part. Witnesseth that for and in consideration of the sum of fifty dollars hand paid by the said John A Pittman at and before the sealing & delivery of these presents the receipt and payment whereof is hereby acknowledged hath bargained & sold and by these presents doth bargain & sale unto the said John A Pittman his heirs and assigns forever all that tract or parcel of land lying & being in said County on the waters of South Broad River adjoin- ing land s of James E Carruth and Dolters containing Eighty-four acres be the same more or less beginning at a Red Oak corner running thence south Eighty east twenty eight chains and fifty links to a Red Oak corner thence South ten west thirty three chains to a Black Gum corner thence North Eighty west twenty five chains & fifty links to a pine corner thence North sixteen East thirty chains to the beginning being the same where Irodel Carruth now lives. To have and to hold said bargained land and premises together with all and singular the rights members and appurtenances belonging or in any wise appertaining thereunto to bind the said John A Pittman his heirs and assigns forever in fee simple 275 not only against the claims of them the said Irodell Carruth Alford Carruth Josiah Carruth James E Carruth Isaac A McEwen in right of his wife James C Freeman in right of his wife and Elizabeth Carruth being the heirs and legal representatives of Adam Carruth deceased but also against the claim of all and every person or persons whatever. In witness whereof the said Irodell Carruth Alford Carruth Josiah Carruth James E Carruth Isaac A McEwen James C Freeman and Elizabeth Carruth in there aforesaid Representative capacity have hereunto set their hand and affixed there seals the day and year first above written his Signed Sealed and Irodell X Carruth {Seal} acknowledged in presents mark of Alford Carruth {Seal} John Cleghorn Isaac A McEwen {Seal} his John P. X Floyd Elizabeth Carruth {Seal} mark James C Freeman {Seal} James E Carruth {Seal} his Elendor X Carruth {Seal} mark Georgia } Madison County } personally came before me John P Floyd who being duly sworn deposeth and saith that he saw Irodell Carruth Alford Carruth Isaac A McEwen Elizabeth Carruth James C Free- man James E Carruth & Elendor Carruth sign seal and deliver the within Deed for the purposes therein mentioned & that the deponant subscribed the same as a witness & saw John Cleghorn do so likewise. James C Freeman married her sister, Elizabeth. Confirming the children of Adam Carruth & Elizabeth as Alford (b 1791 Rutherford Co, NC), Cynthia (Cinthia) (b 1795-1800 Rutherford Co, NC), Elizabeth (b 1795-1800 Rutherford Co, NC), Josiah (b 1797 Rutherford Co, NC), Iredell (Irodell) (b 1803) and James Elbert (b 1814), Also note that Josiah Carruth signed as Elendor Carruth when he made his mark and was referred to as Elendor when John Floyd appeared before the JP 8 Sep 1845. There was an unknown male aged 10-15 (b 1785-1790) who appears on the 1800 Rutherford Co, NC census in Adam’s household & does not appear on succeeding census records. This child could be either a child of Adam & Elizabeth or possibly either of Adam’s younger brothers Alexander (b 1784) or William (b 11 Oct 1785) visiting in the house at the time they were enumerated.
