All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Michael Black mmblack@valdosta.edu February 24, 2007, 9:13 pm Written: February 10, 1841 Recorded: February 10, 1841 Madison County, GA Superior Court Deeds Records and Mortgages Book H (1840-1844) pages 12 and 13 page 12 Georgia } This Indenture made this tenth Madison County } day of February Eighteen hundred and forty one between Mathew J Black of the one part and James Daniel and John Scott of the other part all of the County and state aforesaid Witnesseth that the said Mathew J Black for and in consideration of the sum of one dollar in hand will and truly paid the receipt and payment whereof is hereby acknowledged at and before the sealing and delivery of these presents hath granted bargained and sold and doth by these presents grant bargain and sell a certain tract of land situate lying and being in the County aforesaid on waters of South Broad River adjoin ing lands of Barney Bone John Beard and others containing four hundred + seventy-five acres be the same more or less Also five negroes to wit Mourning a woman twenty seven years of age Betsey a girl about eight years of age Barnet a boy about six years of age Jane about four years of age and Jerry a boy about two years of age To have and to hold the above described tract of land together with all and singular the rights members + appurtenances thereunto belonging or in any wise appertaining as well as the negroes heretofore described to the said James Daniel and John Scott their heirs and assigns forever Now be it understood that the said Mathew J Black on the seventeenth day of December last past borrowed from the Central Bank one thousand dollars in bills due by said Bank and gave as securities upon said note the said James Daniel and John Scott for the said Mathew J Black promising page 13 to give them a mortgage upon the property above and herein described and by virtue of said promise him the said Mathew J Black offered his note Court as follows to wit Milledgeville Sept 17th 1840 $1000 Three hundred and sixty days after date I promise to pay to the order of John Scott one thousand dollars at the Central Bank of Georgia for value received signed Mathew J Black and endorsed on the back John Scott James Daniel and obtained the full amount in Central Bank bills according to the rates + regulations of said Bank. Now if the said Mathew J shall will and truly pay said note agreeably to the premiums and regulations of said Central Bank then this deed of mortgage is to be null and void otherwise the property herein described as bargained and sold to the said James Daniel and John Scott is virtually and to all intents and purposes subject to a foreclosure of the equity of redemption against the said Mathew J Black as soon as they pay off and discharge said note provided that the said James and John become liable to pay the same as endorsers by the failure or neglect to pay of the principle the said Mathew J Black In testimony whereof him the said Mathew J Black hath hereunto set his hand and affixed his seal the day and year above written Mathew J Black {seal} Signed sealed + delivered in the presence of W C Carithers Recorded 10th Feby 1841 A Crawford J.
