Brown of the county and state aforesaid of the one part and James D. Power of the same place of the other part = Witnesseth that the said Samuel B. Brown hath this day made and delivered to the said James D. Power his certain promissory note subscribed with his hand and bearing even date with these presents whereby the said Samuel B. Brown hath promised to pay the said James D. Power or bearer One Hundred and Eighty-Seven dollars and Fifty cents on or before the Twenty-Fifth day of December (word illegible) ensuing the date here of for value received now for and in consideration of the sum of Five dollars by the said James D. Power to the said Samuel B. Brown in hand paid the receipt whereof is hereby acknowledged as well as for the better securing the payment of the aforesaid promissory and the said Samuel B. Brown hath granted, bargained and sold and doth by these presents grant, bargain and sell unto the said James D. Power his heirs and assigns all that tract or parcel of land situate lying and being in the county aforesaid on the waters of Holly Creek containing One Hundred and Five acres more or less and joining land of William Eberhart, Asa Deadwyler, (illegible) Vaughn and others. To have and to hold said bargained promises to the said James D. Power his heirs and assigns to his and their own proper use, benefit and behalf forever and the said Samuel B. Brown for himself, his heirs and assigns the said bargained promises unto the said James D. Power will warrant and forever defend against the claims of himself and his heirs and against the claims of all other persons whatever provides. Never-the-less that if the said Samuel B. Brown, his heirs and assigns shall and do will and truly pay or cause to be paid unto the said James D. Power, his heirs and assigns, the aforementioned sum of One Hundred and Eighty-Seven dollars and Fifty cents on the day and time mentioned for the payment thereof in the said promissory note mentioned with lawful interest for the same according to the lessor of said note then and from thence forth as well this present indenture and the right to the property thereby conveyed as the said promissory note shall cease, determine and be void to all intents and purposes. In testimony whereof the said Samuel B. Brown hath hereunto let his hand and seal the day and year first above written. Signed, sealed and delivered in the presence of: (Samuel B.
