CHARLES BERRYMAN, Will In the name of God Amen, I Charles Berryman of the State of Georgia and County of Madison being of sound mind and disposing memory, and calling to mind the I uncertainty of transitory times & the certainty that all mankind must die, knowing that my stay upon earth is but short and that I must soon meet my God in an eternal world and it pleaseth the eternal Jehovah to call me hence. Oh may Israels God be with me and with all this human family in the hour of death is my prayer, forever & ever. Have thought proper to make and ordain this my last will and testament. Ano first, I resign my body to its mother Earth from whence it came, and my immortal soul to God who gave it, trusting in the merits of a Crucified Redeemer for the remission of all my sins. And secondly as Tuching my temporal Estate which it has pleased God to bless me with, I give and bequeth in the following manner to wit, Item 1st I give to my beloved wife Nancy Berryman, one horse, saddle & bridle, and one bed & furniture, and to have the house in which I now live and one third of the land including the house in which I now live, for and during her natural life, and at her death the house & lands to go to my son Charles Taber Berryman and the other two thirds of said tract of land I give and bequeath to my said son Charles Taber Berryman as soon as he arrives to the age of twenty one years or marries. If my said wife & my son Charles can agree to and live together is is my will they should enjoy the houses & lands jointly so long as they can agree to do so. Item 2, I will all the ballance of my real estate which I now or may hereafter own be equally divided between my following children to wit, Rutha T. Berryman, Frankey Pen Berryman, Wilson Penn Berryman, Y'Nancy S. Berryman, Robert Washington Berryman, Betsey Caroline Berryman & Anna Manning Berryman, share & share. 3rd I will the following Negroes to be equally divided between all my eight children above named to share & share alike in value. towit, Salt a woman, Dick, Joshua, Vincent, Peter, Edmond, Harriet, & Mary, and any other negroes that I may have born or git before my death - and if any of the above negroes should die before a division, each of my said named children to loose alike, and if I should sell or purchase Lands the same to be an equal gain or loss to the said Children - and if any of my said children die, without lawful issue of his or her body, then their share or part to be equally divided between the rest of my childrem here named. Item 5th. I give unto my son Maxamillian Robertson Smith the sum of one hundred dollars to be paid in money or property as my executors may see proper, If called on by said last mentioned son, but not to an Ex. or Adm. or Legatee of the said Maxamillian R. Item 6th, I give to my daughter Molly Toliaferro Bragg, wife of George Bragg, two dollars to be paid by my executors, And to have no other part of my Estate. Item 7th My will is that my executors keep my property Real & personal together until my youngest child becomes of age, or as any of them comes of age or marries give them then their equal share as before stated. It is also my will that my children have a good English education out of my estate and the profits of my Estate over & above a support and any money or notes to be divided equally amongst my Eight first named children, and that all my estate Personal not particularly named, and any that I may hereafter acquire be equally divided among my said eight children, first named,as they become of age or Marry. And I do hereby constitute and appoint, Benajah Houston of the county of Elbert - my wife Nancy Berryman, & Charles Taber Berryman, my Executors - to this my last Will & Testament hereby ratify and confirming this and Renouncing all others, this being my only true & last will & testament. In testimony whereof I have hereunto set my hand & seal this 8th day of August 1827 - A cow & calf & sow & Pig to my wife Nancy Charles X Berryman (mark & seal) Signed Sealed & acknowledged before us. Job Weston James Edwards T Speed Codicil I give and bequeath to my son Wilson P. Berryman a good horse saddle & bridle, & suit of cloths out of my estate over above his distribution share hertofore mentioned. Item 2 - I will & bequeath that my wife have & keep a certain negro woman Sall for and during her natural life or widowhood, and then to go to and be divided between my said Eight children, herein before named together with the increas from this time, Silvy a girl being born since the making of this will is to be considered in the division of the negroes before mentioned. Also I give & bequeath to my daughter Rutha Toliver Berryman a certain negro girl named Harriett, over and above an equal share with the rest. And I do hereby constitute & appoint William Huston an Executor with the rest, to this my last will & testament and codicil - In Witness whereof I have here unto set my hand & seal this twenty fifth day of September 1828. Houston Codicil The negro girl Harriett which I gave to my dauther Rutha Tolever Berryman, over an above her share I do now revoke, in this that the negro may remain with her and keep her at full valuation as a part of her share, so that the other named children have an equal share of said negro, hereby withdrawing the said gift from her & placing the negro to be equally divided among the rest of my children, and let all my children when they come of age or marrys to have a negro at valuation in par of their share.
