Booth - abooth@ktc.com 27 Dec 2000 ***************************************************************** LDS Library, Film # 0351750 Will Records 1811-1922..page 239 Madison County, Georgia Georgia; Madison County: That Whereas I Peter David of said State and County being of advanced age but of Sound and disposing mind and memory and knowing that by the laws of nature that I must shortly depart this life deem it right and proper that I make some disposition of the property with which a kind Providence has blessed me. do therefore make this my last will and testament hereby revoking all others heretofore made by me Item 1st I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances in life, my Soul I trust shall return to rest with God who gave it. Item 2nd I desire and direct that all my just debts be paid by my Executors hereinafter appointed as I am ______________________ in their just rights ..especially as there is no necessity for delay. Item 3rd...I give and bequeath to my Son John M. David one third of a tract of land known as the Moon tract. Also an equal distributive share of my Estate after certain Grand Children is (sic) paid off... the different amounts hereinafter bequeathed to them. Item 4th...I give and bequeath to my daughter Sarah Ann Eades an equal distributive share of my estate after certain Grand Children receives (sic) the specified amount to hereinafter mentioned. Item 5th... I give and bequeath to the Children of my son William W. David deceased an equal distributive share of my estate after certain Grand Children receives (sic) the Specified amounts hereinafter bequeathed to them. Item 6th.... I give and bequeath to the children of my daughter Rachel C. Vaughn dec'd an equal share of my estate after the hereinafter specified amounts have been paid. Item 7th... I give and bequeath to the children of my daughter Mary W. Meadows, dec'd an equal distributive share of my estate except to what I have heretofore given Mary T Mathews (?) and Elizabeth Meadows my grand children after the hereinafter Specified amounts have been received by my grand children as referred to in Item fifth and Sixth. Item 8th.. I give and bequeath to the children of my daughter Elizabeth E. Vaughn an equal distributive share of my estate after certain Specified amounts as in Item fifth and Sixth have been paid. Item 9th...I give and bequeath to the children of my son James M. David an equal distributive share of my estate except his son James P. David I give and bequeath one hundred dollars in Gold when he becomes of age which I direct to be taken out of my estate before an equal division takes place. Item 10th..I desire and direct that the children of my Son Henry H. David viz Henry C. David be paid Five dollars Georgia Ann N. Power (?) Five dollars John M. David, Jun (sic) fifty dollars and Mary E. Hemdon fifty dollars all of which I direct to be paid out of my estate before the equal division takes place. Item 11th.. I hereby constitute and appoint my Son John M.
