This indenture made this 25th day of March 1878 witnesseth that I have purchased of WL Tillman & Co the amount of Fourty dollars which sum I owe to said WL Tillman & Co, their heirs and assigns the following property; to wit: 50 acres of land, north east quarter of Lot No. 246 in 11 Dist., 2 cows, 1 oxen, 7 head of hogs, 10 head of goats, 6 acres in cotton and 8 in corn. To have and to hold, with all appartenances to the said WL Tillman & Co, their heirs and assigns forever; and I do warrant the title to said property to the said WL Tillman & Co, their heirs and assigns against the claim of all persons whatsoever and in consideration of said debt I do hereby waive and renounce all right to Homestead and Exemption in and to said property and also to all other property which I now have or may hereafter possess under the Constitution and laws of said and under the laws of the United States commonly called Bankrupt Laws in for of said WL Tillman & Co, their heirs and assigns. And it is further agreed that if the said WL Tillman & Co shall advance to me during the present year any money or provisions over and above the amount of this Mortgage this instrument shall also stand as security for the same as fully as if included in said Mortgage. And if said amount is not paid at maturity WL Tillman & Co or bearer shall take charge of said property and crop and sell at public outcry after giving 5 days notice at any two public places in the county and sell for cash; and I further declare all of said property and crop unincumbered. Provided, if I pay said sum on the day it becomes due, this Mortgage and waiver shall cease and be void, if not to draw interest at the rate of twelve percent per annum until paid and all lawyers, fees and other expenses for collecting, if any.
